I. SUMMARY
Lynden Township, Stearns County, Minnesota (“Lynden Township”, “Township”) is
requesting proposals from firms and individuals (“Building Official firm”) to fulfill Chief
Building Official duties to provide building inspection and related services to Lynden
Township. Proposal responses submitted must be sent by US Mail or other courier service
and must be received by the Lynden Township Clerk no later than 3:00 p.m. on February 18,
2015. Proposals responses should be sent to:

Each proposal response must be signed by an authorized representative and must include
seven (7) printed copies of its proposal and one PDF version on a CD/DVD. Each
proposal submitted shall be valid for ninety (90) days. The Township will evaluate proposal
responses and select one or more for an interview regarding the proposal with the interview
panel which will include the Township Board and other persons it may seek to assist.
II. GENERAL INFORMATION
Lynden Township is located in southeast Stearns County with a population of 1,933
people having 699 households and is surrounded in part by the cities of St. Cloud, St.
Augusta, and Clearwater. The township consists of a total 25.5 sq. mi. (Land - 23.9 sq. mi,
Water - 1.6 Sq mi.); has!39.1 miles of Township Roads; Tar -12.5 miles; Gravel - 26.6 Miles;
and, an Elevation of 971 ft. above sea level. There are two industrial parks in the township.

III. GENERAL CONDITIONS
The Lynden Township reserves the right to reject any or all proposals, to waive any
irregularity in a proposal, to accept a proposal that is not the lowest proposal based on fees,
and to accept or reject any item or a combination of items. The Lynden Township further
reserves the right to reject proposals that do not contain all elements and information
requested in this document. The Lynden Township shall not be liable for any losses incurred
by any consultants submitting proposals. All services will be provided pursuant to a written
contract between the Lynden Township and the Building Official firm, which shall be
negotiated and mutually acceptable to both parties.

IV. TERM OF CONTRACT
The initial term of the proposed contract shall be for a period of one (1) year
commencing on or around the date a contract is approved by the Lynden Township Board
and shall be renewed based on the provisions negotiated in the contract. Lynden Township
will be allowed to terminate this contract with thirty (30) days written notice if the Building
Official firm does not perform services in a satisfactory manner, loses its license to perform
any of the services, and/or becomes insolvent, or other similar reasons. Lynden Township
reserves the right to extend the length of the contract.
V. SCOPE OF SERVICE
A.
The Lynden Township wishes to contract with the Building Official firm to provide
the following services:
1.! Certified building official. This classification is granted to a person who has met the
“certified building official” prerequisites of part 1301.0300 of the MN Administrative
Rules or its successor rules and successfully passed the written examination prepared
by the state.
2.! Provide building inspection services for all levels of construction – residential and
commercial.
3.! Implementation and enforcement using provisions of the Administrative Code
Ordinance enforcement program as needed, or referrals to Township attorney for
civil or criminal enforcement action.
4.! Provide ordinance/code enforcement and inspection services including but not
limited to zoning, variances, conditional use permits, state fire code, dog kennels,
hazardous conditions, and general ordinances of the township.
5.! Maintain adequate inspection records as required and safeguarding same from
damage or destruction and provide copies to the township without cost as requested.
B. Summary of Expected Performance Standards:
This subsection provides a summary of the minimum expectations of the Building
Official firm. Final provisions shall be worked out during the contract negotiations.
1.! Qualified personnel shall perform all services as required and shall maintain all
necessary certificates and licenses required to perform such services.

2.! Except when, and if, the workload demands otherwise, all inspections by the Building
Official firm shall be conducted within the normal business hours of 8:00 a.m. to 5:00
p.m., Monday through Friday.1
3.! The Building Official firm shall provide a monthly report –both printed and
electronic, i.e. Excel, PDF--to the Lynden Township Board and Planning
Commission via the Lynden Township Clerk. The report shall be available prior to
the monthly Board meeting. The report shall disclose the following information
including but not limited to:
a.! building permit identification number
b.! type of permit
i.! residential
ii.! commercial
c.! permit kind
i.! plumbing
ii.! mechanical
iii.! roofing
iv.! siding
v.! et al
d.! address of permit
i.! street address
ii.! PID
e.! property owner name
f.! contractor name
g.! project summary description
h.! $ valuation of project
i.! permit fee, plan check fee, amount of state surcharge, and other fees
4.! The Building Official firm shall provide a year-to-date report of the same report.
5.! The Building Official firm representative shall attend the monthly Board meeting,
providing progress reports on building, ordinance, and other enforcement activities
or assigned tasks from the Township Board.

permit consultation to Lynden Township citizens and to meet with Lynden Township staff – this item will be negotiable
based on need.

6.! The Building Official firm shall prepare all required reports including but not limited
to building permits, inspections, and fee collections and transactions as required by
the State of Minnesota, Stearns County, or Lynden Township. Similarly, this shall
apply to ordinance/code enforcement and inspection services including but not
limited to zoning, variances, conditional use permits, state fire code, dog kennels,
hazardous conditions, general ordinances of the township, and other enforcement
and inspection items as assigned by the Township Board.
7.! The Building Official firm shall establish and maintain an office with a mailing
address, and a telephone number for scheduling inspections and general inquiries.
8.! Written materials should be provided to the Lynden Township that outline
application requirements and code information for various types of permits (i.e. new
home, deck, finish basement, roofing, mechanical, plumbing, etc.). These materials
shall be clear and concise and current.
9.! The Building Official firm shall have or acquire, expert knowledge of the Stearns
County government, ordinances, and its Environmental Services Department; the
State of Minnesota and it agencies relating to the enforcement of the Minnesota State
Building Code; Minnesota State Fire Code; and, Lynden Township Ordinances and
inter-government agreements.
10.!It is of the utmost importance that the Building Official firm that is hired maintains a
high level of communication with Lynden Township staff, Lynden Township Board,
and its citizens requesting a permit in regard to the permitting and inspection process.
VI. CONTENT OF PROPOSAL
The purpose of this section is to identify the information that must be submitted in
the proposal in the following order:
A. Building Official Firm Information Sheet
The Building Official firm Information Sheet attached to this request for proposals
shall be filled out in its entirety and returned with each proposal response.

B. Summary of Understanding of Proposed Services:
A prospective Building Official firm should indicate an understanding of the
requested services as described in Section V. Scope of Services, and describe in relative detail
how it proposes to service Lynden Township in each of these aspects.
C. List of Qualified Inspectors:
A list of qualified individuals and copies of their licenses and certifications that can
fulfill the various services described in Section V. Scope of Services. The individual (s) designated
as the “Chief Building Official” shall be certified as a building official by the State of
Minnesota.
D. References:
Provide in your proposal response a list of all building inspection contracts currently
held in the last five (5) years, and a municipal representative from each location that Lynden
Township may contact.
E. Indemnification, Cost of Services, and Billing Methods:
The proposal response must include a comprehensive fee schedule, identifying
specific rates for services rendered and any penalty fees. The Building Official firm shall also
describe the billing method and timetable to be employed in the collection of building
permit fees, the payments to the Township, and payments to the State of MN surcharge.
The Building Official firm shall carry the following insurance types with the
minimum liability limits as indicated and shall provide verification prior to signing a contract
with the Lynden Township:
a.! Auto Insurance: A Certificate of Insurance for owned, hired, and non-owned
auto usage coverage for liability in the amounts of $100,000 per claim, $300,000
per occurrence coverage for personal injury and $25,000 per claim, and $50,000
per occurrence for property damage insurance.
b.! General Liability Insurance: General Liability Insurance in an amount of at
least $1,000,000 single limit coverage, covering all personnel employed by the
Building Official in the capacity of Lynden Township of acting as an Agent of the
Township.
c.! Specific Insurance: Workers Compensation, Disability and any other insurance
coverage shall be the responsibility of the Building Official firm.

F. Other Services:
Please indicate in your proposal response if your Building Official firm is willing/able
to provide any additional services and a list of additional services and costs associated.
G. Signed Statement of Understanding:
The proposal response should contain the following statement and must be signed by
the individual authorized to represent the Building Official firm:
We/I have read the Lynden Township’s Request for Proposal (RFP) for Building
Official firm services and fully understand its intent. We/I certify that:
•! We/I have proper credentials, licenses, and are certified to perform the requested
services to Lynden Township; and,
•! We/I have adequate personnel, equipment and facilities to provide the Lynden
Township’s requested services; and,
•! We/I have thoroughly examined the RFP requirements, and our proposed fees
cover all the services that we have indicated we can provide; and,!
•! We/I understand the application of MN Statute § 13.05 which reads:
!! Subd. 11. Privatization. (a) If a government entity enters into a contract
with a private person to perform any of its functions, all of the data created,
collected, received, stored, used, maintained, or disseminated by the private
person in performing those functions is subject to the requirements of this
chapter and the private person must comply with those requirements as if it
were a government entity. All contracts entered into by a government entity
must include a notice that the requirements of this subdivision apply to the
contract. Failure to include the notice in the contract does not invalidate the
application of this subdivision. The remedies in section 13.08 apply to the
private person under this subdivision.
(b) This subdivision does not create a duty on the part of the private
person to provide access to public data to the public if the public data are
available from the government entity, except as required by the terms of the
contract.
