Module 2 – Arbitration Course Application form About the Course The Chartered Institute of Arbitrators Kenya Branch has organised the above two-day tutorial course to be held at Nairobi Club on:Tutorial 1 – 6th March 2015 Tutorial 2 – 10th April, 2015 This course is designed to give you sufficient knowledge and understanding of the Law, Procedure and general Practice of arbitration. The course will take the form of 2 Tutorials (lectures & discussions). It is based on the content of a Workbook which will be collected after finalizing with the application process in advance. The above course will commence on Friday 30th January, 2015. This Course is for you if: • • • • You have passed Module 1 (Contract, Tort & Evidence), Part IIA or equivalent You are at the moment classified as “Associate Members” and are Lawyers by profession. You are a Lawyer and have passed the Entry Course in Arbitration Law & Practice Examination. You wish to improve knowledge of Arbitration Law & Practice even if you will not participate at the exam. The course is a must for those who would like to progress to “Member” level. The Course content • • • • • • • • Arbitration in the context of the range of methods for resolving disputes Fundamental Principles of the Arbitration Process The Arbitration Agreement, Appointment and initiation of an arbitration Arbitrators Jurisdiction and Powers Pre – Hearing procedure and The Hearing Costs & Interest The Award Role of the Court Course Assessment Assessment of this module is by a combination of one written coursework assignment and a 2 1/4 – hour written open-book examination, contributing 20% and 80% to overall marks respectively. In order to pass, you will be required to achieve 55% in both the assignment and examination. Intended learning outcomes On successful completion of this module, you should be able to:1. 2. 3. 4. Explain and apply the principles contained in the syllabus. Appreciate the significance of the role of the Arbitration Act when deciding disputes. Recognise the ambit of the powers of an arbitrator. Appreciate the requirements for an enforceable award. MEMBERSHIP Please note that all subsequent assessments are membership examinations. Thus, ALL applicants are expected to have regularised their membership with the Chartered Institute of Arbitrators. The membership application forms were issued to you with your Entry course results. Tutorial Fees The Tutorial fee is Kshs 38,000/= which includes the course materials, coffee/tea and lunch. The fee can also be paid by instalments provided the first instalment of Kshs 19,000/- is received on or before the closing date of Friday 30th January, 2015 and the balance paid in full before Friday 20th March, 2015. Extra cost for postage or delivery of the materials before course commencement will be borne by the participants. Examination Fee The examination fee is Kshs 20,500/=. This being a membership examination, participants will be required to have regularised their membership before sitting for the examination. The Examination will be based on the 1996 English Act. The Examination fee can also be paid by instalments provided all instalments are paid before Friday 20th March, 2015 Materials Course materials will be available for collection or delivery at candidates cost or upon payment of the course fees. All participants will be expected to have the Arbitration Acts 1995 & 1996. Venue The Tutorials will be held at Nairobi Club.
