CCA Board Sets Legislative Priorities
CCA Sponsors Provider
Non-Discrimination Bill
Assembly Member Ed Chau introduced
our sponsored non-discrimination bill
again on December 1, 2014. AB 41
will codify into California statute nondiscrimination language identical to
that contained in Section 2706(a) of the
Patient Protection and Affordable Care
Act (provider non-discrimination). Specifically, this measure would prohibit a
health care service provider who is acting within the scope of that provider’s
license or certification. A press release
has been sent to the media regarding
AB 41 and appeared in the Sacramento
Bee on December 16, 2014.
Naturopathic College Visit
and Scope Expansion Bill
Drs. Brian Stenzler and Jason Shumard
toured Bastyr Naturopathic College in
December. While generally impressed
with the education and training, both
had concerns regarding the relatively
limited number of hours in training in
manipulation.
CCA was informed that the California
Naturopathic Doctors Association now
intend to remove the language regarding the ability to perform Grade 5 manipulation from their scope expansion
bill. The language is not finalized but
CCA will keep a close watch when the
bill is introduced.
Clean-up Language to
Chaptered Assembly Bill 1000
With the passage of AB 1000, Business
and Professions Code Section 2620.1
was added which defines the criteria
a patient may access physical therapy
services directly from a physical therapist without a referral for the lesser of a
period of 45 days or 12 visits. After that
time, a signature approving the physical
therapists’ plan of care is required from
physician and surgeon, an osteopathic
physician and surgeon or a podiatrist.
Assembly Member Brian Maienschein
has stated that he plans to introduce
legislation to address the doctor of chiropractic referral to a physical therapist issue created by AB 1000 in January. CCA will be working with Assembly
Member Maienschein to author the
necessary clean-up language thus add-
ing doctors of chiropractic to the list of
providers in Business and Profession
Code Section 2620.1 (a) (4) who can
determine if additional physical therapy
treatment is necessary.
Workers’ Compensation
Proposed Clean-Up Legislation
CCA lobbyist Monica Miller, with Governmental Advocates, is continuing to
seek an author for proposed Workers’
Compensation bill. One of the main
strategies is to meet with stakeholders who would likely oppose the bill
and also coalition build with supportive
stakeholders.
Dr. Wayne Whalen, member of the CCA
Workers’ Compensation Committee,
flew up to Sacramento on Tuesday, December 16, 2014 to join CCA in meetings
with stakeholders who will likely oppose
our bill. We met with the chief consultant for the Assembly Insurance committee, the California Chamber of Commerce, the California State Association
of Counties and Jason Schmelzer with
California Coalition on Workers’ Compensation. The outcome of the meeting
was positive although there is not a lot

stakeholders including labor and the

this legislation forward, Governmental Advocates will be placing the bill as
non-backed in status as actual language
is being developed.
Board of Chiropractic Examiners
and Sports Physicals
In an effort to address the statewide
issue of doctors of chiropractic being
unable to perform pre-athletic physicals, the BCE authored an opinion letter directly to the Schools Insurance
Authority (SIA) and will also be sent to
the California Interscholastic Federation
(CIF). SIA has repeatedly denied doctors of chiropractic to be added to the
list of providers that can provide these
physicals citing faulty research as to
why chiropractors should be excluded.
The BCE stated that chiropractors are
duly authorized as part of their scope of
practice and are also highly qualified to
do so.

Dear CCA,
I just looked at my CCA membership profile, and I have attended 24
seminars since 2000. At an average of $300 a seminar, it works out
to a grand total of $7,200 in saved education costs. At an average
of $60 a month, that works out to $10,080 over the last 14 years,
leaving a total cost of membership of $2,880. When the savings
in insurance savings costs are figured in over the last 14 years, we
saved about $200 per month. We have premises, liability, auto and
work comp through a group discount deal brokered by the CCA.

Veteran Capitol Staffer Cris Forsyth Announced
as CCA Governmental Affairs Director
The California Chiropractic Association
(CCA) announced the hiring of longtime
capitol staffer Cris Forsyth as the association’s new Governmental Affairs
Director. Most recently, Forsyth served
as a chief of staff in the California Legislature.
“Cris Forsyth brings more than two decades of experience and expertise to
implement pro-chiropractic legislative
and regulatory strategies,” said Dr. Brian
Stenzler, President of CCA. “His broad
perspective on governmental policy at
the state and local levels, and his depth
of experience as a legislative chief of
staff, campaign manager, lobbyist, and
educator makes him a perfect fit to implement CCA’s vision.”

Oaklahaven’s Have-A-Heart

Bobby Doscher, D.C. has never doubted
that sick kids benefit greatly from chiropractic’s unique approach to improving
health. Dr. Bobby has been the CEO and
lead doctor at Oaklahaven Children’s
Chiropractic Center since she first accepted that post 36 years ago in 1979.
At Oaklahaven, chiropractic care is provided to children at no charge. The parents of the very sick children who make
their way there have typically run the
gamut of every possible medical remedy, spent hundreds of thousands of
dollars, and ended up broke and broken
hearted. Many come to Oaklahaven as a
last resort, one last hope.
Oaklahaven was begun in 1962 in response to the need of caring for chronically sick children. The founders decided
to provide chiropractic care through a
nonprofit 501(c)(3) organization. It was
the generosity of the private sector and
colleagues who donated their chiropractic expertise and skill that first sustained Oaklahaven’s ability to provide
natural drug-free health care to children. Oklahaven has continued to operate through private donations without
federal, state or United Way funding for
more than 50 years.
How many chronically sick children are
out there who need care? The statistics
can be overwhelming. It is estimated
that 43 percent of children in the United States (32 million) have at least one
chronic health condition, and 19 percent (14.2 million) have health conditions requiring special health care.1
The Centers for Disease Control (CDC)

reports that about 1 in 6 children have
a developmental disability, and 1 of every 68 children is autistic2. Children today comprise the first generation in the
United States predicted to have a shorter lifespan than their parents.3

are more toxified and stressed today
than ever before, but it is these children
who demonstrate so well the chiropractic premise. Children begin to express
better health one adjustment at a time,
and her greatest joy is seeing these children become whole again. Dr. Bobby
tells of babies holding their head up
for the first time, sleeping through the
night, making it through day after day
with no seizures, eating without pain,
and children feeding themselves for
the first time, moving independently,
speaking clearly without a stutter, and
running and playing like a normal child
without asthma or chronic ear infections.
She has been named Woman Chiropractor of the Year and is one of the Twelve
Great Women in the History of Chiropractic, but she is most well known for
her work at the Oklahaven Children’s
Chiropractic Center.
“Now preparing to celebrate its 50th

autistic spectrum), rheumatoid arthritis, diabetes, Down Syndrome, Apert’s
[Apert syndrome] and chromosome disorders, drawing international attention
in the process. And all without state or
federal funding.
“Today, a large segment of Doscher’s
patients are autistic or are afflicted with
an illness along the autism spectrum,
which both intrigues and concerns
Doscher. “First, they were referred to
as ‘idiots’ or ‘morons,’ then they were
‘handicapped,’ then they were ‘challenged,’ then they were ‘special,’ but
now they’re ‘autistic.’ It’s important
to note the symptoms have stayed
the same, and we’ve just changed the
name. But now there are more cases
than ever.””4
Against the backdrop of epidemic levels
of chronic disease in the U.S. and other
industrialized countries, Doscher is well
aware that chiropractors are still being attacked for promoting the health
giving back to our community
of children through chiropractic—even
by some elements in the chiropractic
community. For her, that is a primary
reason for putting herself out into the
community as often as she can. Dr.
Bobby spends a lot of time on patient
education. This includes parent support
groups at Oaklahaven and a series of
“miracle-driven” videos she created for
the parents of patients as well as the
community at large.

Individuals enrolling through the exchange should use caution and accuracy when applying for coverage and
estimating annual income, in order to
prevent an overpayment of subsidy.
If your income has increased from the
amount that you reported to the Exchange and you received a larger subsidy than you were entitled to, you may
have to repay part of your subsidy.
Furthermore, if you and your dependents are eligible for coverage under a
group sponsored health insurance plan,
and that coverage meets Minimum Value and Affordability standards, you and
your dependents would have access to
affordable coverage, therefore not eligible for government assistance. Individuals may feel that their coverage is “not
affordable” for their budget, however,
it is important to speak with a licensed,
experienced, certified agent or enrollment counselor to confirm your eligibility.
How Do Overpayments Occur?
Subsidies are calculated on your tax return using your household income and
family size for the taxable year. To make
income and subsidy determinations,
the Exchange insurance application
asked you to provide specific information about your income. If your current
income was not steady or if it was expected to change, you were asked to
give a projected income on the application. If you did not provide any financial
information, the Exchange used your
federal income tax return from the previous year to calculate your projected
income.
Advance payments of the premium tax
credit are made directly to the insurance company on your behalf. At the
end of the year, the advance payments
are reconciled against the amount of
your family’s actual premium tax credit,
as calculated on your federal income tax
return. If your actual income is more
than your projected income, you likely
have a subsidy overpayment.
How Are Overpayments Fixed?
At the end of each year, your subsidy
amount will be recalculated using your
household income as reported on your
tax return, and any difference in the
amounts must be corrected.
If your income has increased from the
amount you reported to the Exchange
and you received a larger subsidy than
you were entitled to, you may have to
repay part of your subsidy. This could
result in either a smaller tax refund or a
tax payment due. However, if, based on
your household income, you are owed
a greater premium tax credit than you
received, you will receive the excess as
an income tax refund.

Palmer’s San Jose campus was well
represented among the group of chiropractors who provided care for athletes
at the 22nd Central American and Caribbean Games, a multi-sport regional
championships event, held Nov. 14-30
in Veracruz, Mexico.
Held every four years (typically in the
middle year between the Summer
Olympics), the 2014 Games featured
more than 5,000 athletes from 31 countries competing in nearly 50 sporting
events (ranging from swimming, gymnastics and cycling, to table-tennis,
handball, and wrestling, among others)

since the Games’ debut in 1926.

Palmer Had Prominent Role
at Silicon Valley Turkey Trot
For the sixth year in a row, Palmer’s
San Jose campus played a prominent
role in the 2014 Silicon Valley Turkey
Trot (SVTT). Once again, the 25-foamsegment Palmer Spine provided “the
backbone” of the 5K walk, and the
Palmer Chiropractic Clinics provided
complimentary sports-care services for
registrants in an event that debuted
in 1995 with 1,900 participants, and
has since grown to become the largest
timed “Turkey Trot” event in the United
States.
The Thanksgiving morning fundraiser
in downtown San Jose organized by the
Silicon Valley Leadership Group (SVLG),
set new records for participants (more
than 26,000) and donations to local
charities (nearly $1-million).
Palmer College has also been an event
sponsor that past six years, during
which the San Jose Campus has earned
“Fittest Firm” honors three times (for
having the largest number of SVTT participants among companies with 50-100
employees).
Another major feature of the SVTT is the
“Can Do Challenge,” which encourages
SVTT participants to donate cannedfood items, and enables Second Har-
vest Food Bank to brighten the holidays
for less-fortunate families in the South
Bay area by providing bags of groceries.
The Associated Student Government at
Palmer’s San Jose campus showed their
support for the “Can Do Challenge,” by
organizing a donation drive involving
each class, which resulted in the collection of 333 items (with a weight of 336
pounds).

Dick, D.C., a 2003 graduate of Palmer

when the Stampeders recently defeated the Hamilton Tiger-Cats to win their
sixth Grey Cup championship in franchise history, it was a particularly proud
moment for Dr. Dick, who maintains
his primary practice at Riverside Sports
Therapy in Calgary, where he provided
care for some of the Stampeder players
on an individual basis, prior to earning
his appointment as the CFL team’s official chiropractor since 2013.

Held Last December
The 65th commencement ceremony for
Life Chiropractic College West took place
on Friday, December 12th. Two classes, with a total of 50 students, walked
across the stage to receive their Doctor
of Chiropractic degrees. This graduation

California. The BAL Theater was built in
1946 and is a beautiful example of the
era. It was the perfect location for the
pomp and ceremony of a graduation.
Master of ceremonies for the evening
was Dr. Jim Hawkins, who has attended 64 graduations. President, Dr. Brian
Kelly conferred the degrees and greeted
each graduate as they crossed the stage.
The Life West faculty and administrators
were present in full academic regalia
to honor and witness the fine work of
these graduates.
The graduation keynote speaker was
Dr. Guy Riekeman, the President of
Life University in Marietta, Georgia. Dr.
Riekeman is a second generation chiropractor and a world-renown speaker.
Dr. Riekeman regaled the graduates and
their families with stories of chiropractors who made a huge impact on the
world. He urged the graduates to follow
in their footsteps and dream big.
The ceremony culminated with each
graduate crossing the stage to receive
their diploma, the recitation of the chiropractic oath, and finally the students
flipped their tassels from right to left as
they officially became graduates of Life
Chiropractic College West.
A reception was held at the Oakland
Scottish Rite center. Families gathered
to celebrate and dance the night away.

SCU is Developing!
The new calendar year truly marked
a fresh start for SCU as we have officially sold part of our non-essential
campus property. Areas of campus that
were primarily rented out to the community for recreational use have been
purchased by a local developer and will
be converted to single family housing.
The university will run as usual with the
main campus remaining unfazed.
SCU plans to use the money from the
land sale to retire our debt, replenish
our endowment, and build a bigger,
more modern SCU. We are growing as
a university and are excited to take our
campus to the next level. It won’t happen overnight, but we are proud and
eager to report the good news. Over
the next 5 – 10 years we expect to have
one of the best integrated healthcare
college campuses in the country.
