How Much Should a Park Owner “Disclose”
to Prospective Residents?
We are going to start off the New Year with a very interesting program! The California Legislature requires various disclosures to
prospective mobile home park residents and purchasers of mobile homes including, Civil Code Sections 798.74.5 (effective October 1,
2013) requiring rent and other charges to be disclosed; Civil Code Section 798.75.5 (effective January 1, 2000) requiring the park
owner to provide information to prospective residents on the condition of the park’s infrastructure; Civil Code Section 1102 (effective
January 1, 2000) mobile home resale disclosures; and Civil Code Section 1003 (effective January 1, 2005) requiring disclosures of
natural hazards that impact the mobile home park. Are there other “disclosures” that should also be considered and implemented by
park owners? This month’s forum will provide an overview of the maze of existing required disclosures and explore the effectiveness and
potential benefits of other disclosures such as disclosing to prospective mobile home purchasers what the actual NADA (off site) value
is of the mobile home they are purchasing so that there is a clear understanding that they may be paying more than the value of the
personal property they are buying. Some parks and many “trailer” parks may be prime candidates for closure and redevelopment in the
future. What is the right time to consider providing disclosure of this fact to prospective purchaser? This thought provoking discussion
will be led by attorney Julie Rubin who will also update us on the status of failure to maintain litigation – tying in how certain
disclosures may benefit park owners in the fight against failure to maintain and other legal action from park residents.
