POLO keeps ban on ex-driver’s agency By Daisy CL Mandap An attempt to process work contracts by an employment agency at the center of an inquiry into alleged misdeeds of former Labor Attache Manuel Roldan and his driver was again foiled by the Philippine Overseas Labor Office on Jan. 22. Reports say Ruby, the mother of the registered owner of Magnificent Maid Employment Agency and wife of former POLO driver Donald Retirado, tried to get contracts accepted at the POLO service windows on that day, but was turned down. Angered by the rebuff, she called in the police, but was instead escorted out of the Consulate premises. It was not the first time that the Retirados had tried to get POLO to allow the agency to process work contracts. On Nov. 17 last year, the agency’s registered owner, Frances Retirado, wrote to POLO’s officer in charge, Ma. In the report issued at the end of September last year, the fact-finding committee pointed out certain acts of Roldan which may have violated Philippine laws and regulations, specifically those pertaining to conflict of interest rules on civil service. This referred in particular to his act of endorsing for accreditation by the POEA the agency owned by the Retirados. In his defense, Roldan claimed not knowing about Magnificent’s ownership initially, but that after he became aware of this, he told Donald not to operate it. The PCG report also disclosed that POLO under Roldan had submitted a tampered copy of Donald Retirado’s employment contract, apparently in a bid to deflect any accusations of wrongdoing. In addition, Roldan was found to have caused the accreditation of 90 additional employment agencies in Hong Kong, despite an already saturated recruitment market. The investigation was launched on Aug. 26, in response to a series of complaints made against Roldan by CSPEM. Hindi naman naging problema nang magpaalam siya sa kanyang amo at sabihin na hindi na siya pipirma ng panibagong kontrata. Nangako rin ang amo na bibigyan siya ng magandang rekomendasyon at release letter. Ang balak ni Lydia ay maghanap ng amo na hindi Intsik dahil sa isip niya ay mahirap pakisamahan ang mga ito at bugbog sa trabaho ang kanyang katawan. Karamihan kasi sa kanyang mga kaibigan ay puti ang mga amo at ayon sa mga ito, mas magaan ang kanilang trabaho at mababait ang mga pinagsisilbihan. Wala rin siyang curfew at may sariling susi sa bahay, hindi gaya ng dati na lagi siyang nagmamadaling umuwi kapag day off dahil baka siya mapagsaraduhan ng bahay. Maayos na nakapagsimula si Lydia at naging masaya naman siya sa kanyang trabaho. Walang problema sa pagluluto dahil ang amo niyang babae ang gumagawa nito, at ang pag-aalaga ng bata lang at paglilinis sa bahay ang dapat niyang gawin. Makalipas ang ilang buwan ay sinabi ng kanyang amo na siya ay nagdadalantao. Nagulat si Lydia ngunit hindi siya nagpahalata. Hindi niya kasi akalain na masusundan na agad ang alaga niya dahil mahigit isang taon pa lang ito. Makalipas ang siyam na buwan ay nanganak na ang kanyang amo, at lalong nadismaya si Lydia dahil kambal ang bago niyang aalagaan. Tamad kasing mag-alaga ang kanyang amo at kahit nasa bahay lang ito ay sa kanya iniaasa ang mga anak nito. Nag-umpisa ang kalbaryo ni Lydia nang umuwi na sa bahay ang kambal at ang bagong panganak na amo niya. Sa araw-araw ay tatlong bata ang inaasikaso niya mula pagpapaligo sa mga ito hanggang sa pagpapakain kaya’t lupaypay ang kanyang katawan pagsapit ng gabi. Hindi na nga siya nakakapanood ng mga paboritong teleserye sa internet. Abot-abot ang daing at reklamo niya kapag kahuntahan ang mga kaibigan tuwing day off niya. Sabi nga ng isang kaibigan, iyan ang napala niya sa paghahangad ng among puti. Nagtiyaga si Inday dahil mabait naman ang kanyang mga amo at dalawang alaga. Kung minsan pa ay may dagdag na pakiusap ang amo na magwalis at maglampaso muna bago siya umalis. Pagkatapos ng kanyang kontrata, inalok siya ng kanyang amo na pumirma uli at itataas naman daw ang kanyang sahod. Noong una ay nagpakipot pa si Inday na tila hindi na siya interesadong pumirma pang muli. Tinanong siya ng amo kung nag-aalinlangan siya na magpatuloy sa pagsisilbi sa kanila. Naglakas-loob si Inday na magsabi tungkol sa maagang curfew niya at ang paghahanda pa ng almusal kapag day off niya. Hindi daw kasi tama ang naging babala ng World Health Organization kung anong klase ng trangkaso ang tatama sa maraming tao sa kasalukuyang panahon, kaya hindi naging ayon ang mga bakunang naihanda. The agency complained of is Joyce Agency, registered with Labour’s Employment Agencies Administration (EAA), and whose listed office is shop 216, Lik Sang Plaza in Tsuen Wan. Vice Consul Charles Macaspac, who heads the Consulate’s assistance to nationals sections, said he referred the five cases filed with his office to labor officers during a recent meeting. He also called on others who might have similar complaints to go to the ATN section so they could study whether a similar referral could be made. The SUN tried to call Joyce Agency owner Fe O. Cheung at the mobile number given by the applicants, but could not get through. Neither she nor her agency had a listed telephone number. One of the complainants was Maribeth Sanchez, who said she paid $20,000 to Cheung in October 2013 after she was reportedly told that an employer was already waiting for her in Canada. Cheung reportedly did not issue any receipt, although Sanchez said she had remittance slips showing at least part of the money being deposited directly into Cheung’s bank account. Sanchez said the money was sent by her aunt in the Philippines, who was convinced to lend her money for her Canada application. But after paying the fee, Sanchez said she was told to “wait” each time she asked Cheung about the job. On Nov. 23 last year, Sanchez said she again went to Cheung’s office to follow up, and was reportedly told that she could be moved to another agency in Canada, but she needed to pay an extra $45,000. She balked. Two days later, Sanchez said she returned to Cheung’s Tsuen Wan office but found it closed. She said she saw “many people” waiting outside, and they reportedly told her they, too, had been cheated by Cheung. Some applied to go to Canada, but there were others who paid for friends or relatives applying to work in Hong Kong. Among those who claim to have paid for a friend in the Philippines is Maritess, who said she did not get any receipt for the $6,500 collected from her by Cheung in August last year. Maritess said she was enticed to file her friend’s application with Joyce because of the many “advertisements” she saw posted in its office. When she saw the agency’s office shut in November, she said she gathered the names and contact numbers of her fellow complainants. She hopes to furnish the list to authorities so they could use it as evidence against Cheung. Filipina helper held over live-out term By Daisy CL Mandap If your employment contract states that you should live with your employer, don’t agree to a live-out arrangement, even if it might cost you your job. This was what a Filipina domestic worker learned the hard way after she was jailed for lying to an immigration officer about living out of her employer’s home, contrary to what is stated in her work contract. D.S.S. was accused of making false representation, despite pointing out she could not have done it without her employer’s consent. And that in fact, it was her employer who told her to live out and stay in a boarding house. It appears the employer, surnamed Sia, has not been similarly charged. When she appeared in Shatin court on Jan. 18, D.S.S.’ bail was cancelled, and she was told to appear again on Feb. 25. She was immediately moved to Tai Lam prison where she remains detained. D.S.S. was questioned at about 6:45am on June 5 last year at an apartment on Tai Yuen road in Wanchai, as she was preparing to go to her employer’s house in Celeste Court in Happy Valley. During the questioning, D.S.S. admitted that she did not live with her employer, contrary to what was in her contract. Records show that D.S.S. had applied to work with Sia on Dec. 12, 2012, and the same was approved on Jan. 9 the next year. In the contract, it was stated that D.S.S. was to live with the employer in Happy Valley. When her visa expired after one year, D.S.S. left for Hong Kong, and on her return, was given permission to continue working with Sia until Jan. 9 this year. She had already finished the contract when told to report to court to face the charge. The records also show that when D.S.S. was interviewed by Sia for the job, the Filipina was told that she could not stay at the employer’s residence as there was already a maid living there. Sia reportedly offered to pay $6,000 a month, which was meant to cover her salary plus accommodation expenses. D.S.S. worked for Sia from Monday to Saturday, 7:30 am to 8:30pm, and lived in the Wanchai boarding house throughout. Despite knowing that the live-out arrangement violated the contract that she signed, D.S.S. did not inform immigration about this when she applied for an extension of stay, one year after starting to work for Sia. Lumicao Consulate officials have found a new way to double the number of newly registered overseas voters: placing the sign-up desk right in the lift lobby of the diplomatic mission at the United Centre in Admiralty. And going by the spike in the number of people enlisting daily for the presidential and national elections in May 2016, the Consulate said it should be able to meet its goal of 20,000 new registrants by the Oct. 31 deadline. According to the overseas voting registration team, a total of 1,412 new voters had signed up for this year, with the new desk at the lift lobby attracting 181 registrants on that Sunday alone. “Last Sunday, we had the biggest number of registrants here at 181,” OVR’s Jethro Tull Dela Cruz said. “We also registered 112 at PNB, so the total was 293.” He said the total figure was the biggest daily tally figure so far. The desk was initially located in the cultural section but as the Consulate stepped up its listing effort, Vice Consul Fatima Guzman decided to move it next to the passport section where many Filipinos gather. However, that location saw only a moderate increase in registrants, so after a week it was moved to the lift lobby, Dela Cruz said. Having the desk in the public area also appeared to add to the overcrowding. The move on Jan. 18 paid off when 141 people registered. That figure, plus the 84 who listed up at the St. Joseph’s Church mobile OVR, brought the number of registrants to more than 200 for the first time. “Isang linggo pa lang kami, mas maganda ang turnout dito, kasi nag-umpisa kami ng Sunday eh…sa isang araw 200 kaagad,” Dela Cruz said. “Kung magtutuluy-tuloy iyon, magkaroon man lang kami ng 60 a day, makakalapit kami sa target na 20,000 sa Oct. 31.” Thus far, the OVR that began last Oct. 1 has reached around 7,300, some 36.5 percent of the 20,000 target. Dela Cruz said Worldwide House is an ideal location for the OVR because many people go there, although many of them are already registered voters. For example, out of 100 who approach the desk, about 50 are already in the active list. Guzman is coordinating with BDO to use a space at the bank for OVR on Feb. 1, said Dela Cruz. “Inaasahan natin na pagdating ng end of January, aabot sa 1,600 iyan, assuming an additional 200 listing up until then,” he said. Amid the excitement brought about by the record figures, the OVR team finds itself grappling with questions over the Comelec ID cards. De la Cruz said the Consulate has written the Commission on Elections to ship the ID cards, to no avail. But he assured voters those IDs would arrive. Lumicao New Labor Attache Nenita Garcia has told Filipino domestic workers to speak up if they have been charged illegal or excessive placement fees by employment agencies. Garcia said the victims should make a formal complaint to the Philippine Overseas Labor Office so she could endorse these to the Philippine Overseas Employment Administration, which regulates recruitment agencies. Garcia buckled down to work on Jan. 8, but officially assumed the post only 17 days later. She took over from former Labatt Manuel Roldan who returned to the home office at the end of September. The new labor chief said that there is a need for both employers and helpers to be educated on the labor laws of Hong Kong. In addition, employers should learn about Filipino culture. The 60-year-old Garcia, who is in Hong Kong for her first assignment as labor attaché, told The SUN in an interview that she came here unaware of any problems at her new post. She said Labor Secretary Rosalinda Baldoz did not brief her about the problems that might be awaiting her in Hong Kong before she left Manila. “Hindi naman po siya nagsabi kung ano yung mga problema sa Hong Kong. Basta ang sabi lang niya ipagpatuloy yung nasimulan na, yung sa (reintegration of) teachers, skills upgrading para sa mga OFW para maupgrade naman ang kanilang kaalaman para pag-uwi nila sa Pilipinas ay mayroon silang ibang trabaho na kayang gawin,” Garcia said. The new labor attaché, who used to be the director of the DOLE’s financial management services office, said she had not heard about Filipino domestic workers being charged excessive fees by recruitment agencies, either here or in Hong Kong. In at least one case reported by The SUN, the helpers were charged a total of $21,000 by a Hong Kong agency, which they needed to pay over seven months through bank accounts controlled by the recruiter. Under Philippine laws, all Filipinos deployed as domestic workers abroad are not supposed to pay any placement fee. But in Hong Kong, a maximum fee of 10 percent of their first monthly salary is allowed. “Ang alam ko lang talaga ay ang policy ng department na no placement fee na kailangan talagang ipatupad. Kung merong nag-complain then we will hear it. Then ii-endorse namin sa POEA kung ano po ang gagawin nila, kung isu--suspend ang license o kakanselahin,”Garcia said. The new labor chief hinted at being given the impression that what the Filipina workers are asked to pay are personal debts that they incurred before coming to Hong Kong. “Pero yung tungkol sa lending, alam nyo ba ang tungkol sa lending?” she said when asked about instructions she had been given by the head office about the illegal placement fees. The SUN told her that the workers often complain about being escorted by their recruiters here to a financing company where they are forced to sign up for loans that they never get. “Alam ko po bawal yun ... ie-endorse po namin sa POEA yun. Basta magsasalita sila eh, paano naman kami tutulong kung hindi sila magsasalita,” Garcia said. “Iyon nga po, dapat siguro ma-educate natin ang mga employer and the worker. Iyon siguro ang dapat nating gawin, saka kailangan siguro na malaman nila ang kultura ng mga Pilipino,” she added. Garcia said one of these days she would pay Hong Kong Commissioner of Labour Donald Tong a courtesy call, though she wouldn’t be taking up any labor issues with him just yet. She noted that “para naman maganda ang labor laws nila, eh, madaling intindihin. Kung susundin lang talaga ay hindi tayo magkakaproblema.” Garcia, who has been in public service for 31 years, said her priority is to preside over the transfer of POLO to its new offices at Admiralty Centre, a pet project of her boss Baldoz. She expects renovation works to be completed on the 11th floor of the office tower in time for a mid-February move. She said the budget for the renovation of the 16th floor has not yet been released, so the next phase of the move would be much later. Asked why she was chosen to head the Hong Kong office, Garcia, an accounting graduate from the former Philippine College of Commerce (now Polytechnic University of the Philippines), replied: “I think the secretary picked me dahil alam niya na nagde-develop ako ng systems as part of my department, saka ako po kasi, very workaholic ako.” Garcia said one of her main tasks is to pursue the BalikManggagawa program for teachers, a joint project between the Department of Education and DOLE; and the skills upgrading of Hong Kong OFWs. For the skills upgrading program, helper graduates of short courses offered by DOLE and other institutions will be tested and certified by the Technical Education and Skills Development Authority (Tesda) so that they could get jobs in Manila. This was the message sent out by the EOC when it recently conciliated a case brought by a foreign domestic worker who was sacked by her employer shortly after being diagnosed with ovarian tumor. According to the EOC’s records, the worker immediately informed her employer after the diagnosis. The helper continued to work while waiting for surgery. During this time, the worker said her employer started to nitpick on her performance. Around six months later, and shortly before the helper’s surgery, the employer terminated their work contract. The maid turned to the EOC for help, alleging that the dismissal was because of her disability. The EOC settled the case through a “fast track conciliation” after the employer agreed to give the helper compensation amounting to about nine months’ salary. Under the Disability Discrimination Ordinance, it is unlawful to discriminate against an employee (including foreign domestic workers) by dismissing him/ her on the ground of his/her disability. But before the tour of the Pokfulam campus began, participants were made to participate in a fitness session conducted by John, a HKU student doing his PhD in reproductive biology, and a designated “ambassador” for the project. Participants were led through a facial exercise, said to have been specially designed for domestic workers who are always under stress. Afterwards, they happily walked around the main campus as student ambassadors explained to them the history of every building. Along the way, they were introduced to a statue of Sun Yat-sen, a revolutionary Chinese leader, and the first president and founding father of the Republic of China. They were also made to observe how buildings built as early as 1912 were beautifully structured. After the tour, the group walked to the Jockey Club Student Village III for lunch, where they also had a chance to know more about the student ambassadors, who shared their experiences at the university. When asked why they took part in the program, the ambassadors said they wanted to learn more about the Filipino culture, and also because they were curious as to why a lot of Filipinos prefer to sit all over Central during their holidays. But turning seriously, they said they wanted to help empower domestic workers and to stop the discrimination against them. She had been working in Samar as a volunteer for the Catholic Relief Services but decided to travel to Tacloban to assist in the mass said by the Pope. Before working as a Kristel Mae volunteer, Kristel was reportedly connected with the human services department of a BPO (business product outsourcing) company. Lumicao Philippine Sluggers, fielding four reserves at the last minute and tactically switching players, reasserted its dominance in Hong Kong women’s Grade C baseball on Jan. 25. The home team reversed an early drubbing to beat guests Fortissimo, 15x-12, in regulation. Catcher Reyzelyn Fulo took over pitching for the inning, subbing for veteran pitcher Don Gaborno who was off for a softball league match, while Lotis Magaling played catcher. At their turn to bat on the Homantin diamond, the Filipinas visibly missed the absent mainstays, including Ely Quimpo, as the WC division leaders were held scoreless, 0-4, by the visitors. “Fortissimo blanked us in the first inning not because they were good but because some of our players who are also in softball had a league match,” Sluggers president Cecil Calsas told The SUN. “There were only nine of us playing. Naturally, I had to call on our reserves and I am glad they rose up to the challenge and gave their best,” Calsas said in a phone interview. Embarrassed by the firstinning setback, Sluggers founder Calsas reshuffled the players. She herself had to play to fill the void left by Quimpo, Gaborno and her Fate A team members Jesse Duque, Romela Osabel and Rachel Tago. Then at Fortissimo’s timeout, Calsas assigned Magaling to pitch and put back Fulo on the home plate. She also reshuffled some positions on the infield and outfield. In the second inning, Fortissimo continued to fight gamely from the plate, but the Sluggers’ switch in pitchers paid off when Magaling struck out some of the visitors or forced errors on them, limiting their runs to four. Lumicao Facing its toughest opponents yet in the top league of Hong Kong women’s softball, the all-domestic worker team Fate A fought bravely, but took its second defeat of the season to title contender Steel amid costly blunders and shoddy officiating at Tin Kwong Road. The Filipinas, newcomers in the A division playing just their fourth game on Jan. 25, got a sampling of what lies ahead in the league when Steel, No. 2 last season, opened the match with two home runs by Kitty Kwong and Yam Wai-yan. At their turn on the plate, Fate struck back courtesy of successive runs by Ma. Eva Mendez, Marge Occenola and team captain Don Gaborno to put the Pinays ahead 3-2, after first to bat Joelle Galapin was put out on the first base. Gaborno set up that homerun spree with a powerful low strike to outfield that the Steel rightfielder chased up to the fence. By the time the rivals retrieved the ball, the Filipinas had all bases loaded. Then Steel fumbled on a strike by Lyka Algonez to the outfield that sent Mendez and Occenola safely home. Gaborno also dashed towards home, but turned back just six feet away from the plate and barely avoided a tag by sliding to third base. Gaborno finally ran home when the next batter, Romela Osabel, hit another ball. After that episode, Steel came back with vengeance in the second inning with a rolling ball to the left field by Lam Pui-kwan that allowed Collette Leung to run home. Then followed three runs in succession by Lam, Kwong and Yeung Man-wai after Yeung blasted a rolling ball to outfield that emptied the bases as Filipinas scrambled to recover the ball. At that point Steel was up 6-4. The second inning was marred by a protest from the Filipinas when the chief umpire called an out on Occenola, who was tagged just a split-second after she touched first base when she hit a rolling ball to infield. Fate A members and officials ham it up despite the loss. Just being in the A league is enough reward. Fate coach Bernie Cabasal and Hong Kong Football Association observer Rusty Russell protested the call, but after a brief consultation among the umpires, they were overruled, drawing catcalls from the Filipinos. Cabasal protested a similar call by the umpire in the fourth but was again ruled out by the official, drawing angry reaction from the Fate dugout and gallery. At the break, Cabasal tried to rouse his players by citing their errors and challenged them to get their act together or pack up, but that seemed insufficient to fire up the Filipinas. “Fate, anong nangyayari sa inyo? Fate looked to score more runs in the fifth inning but each attempt was foiled by Steel, and so was their heroics in the final inning. The team found consolation in Gaborno, one of the league’s best pitchers who struck out most Steel batters in the last two innings. After the game, the Hong Kong players admitted the Filipinas were strong. “They performed well, they’re strong and aggressive,” Steel’s Iris Wong told The SUN. “I know they were just promoted from Shek Kip Mei (where the B league tournament is held),” she said. Steel, fielding mostly lean but mean players, missed just a couple of Fate flyballs to outfield, while putting out 13 Filipinas before they even got to first base with eight catches in six innings. Their speed and agility revealed their age advantage and constant training, compared with the mostly 30 and above Filipinas who jokingly — but with irony and a bit of sarcasm — admitted they practiced mostly with pots and saucers at home, and only once a week on the field. The Filipinas’ sister team, Fate B, meanwhile, has posted a 3-0 win-loss slate in Shek Kip Mei. The newly formed squad walloped their latest opponents, local team Joker, 11-2, on Jan. 18. With competition for honors already tight when the league started last Sept. 28, the championship match is expected to raise tensions as Sluggers seeks to avenge its humiliating 34-53 loss to Smart on Oct. 5. That defeat, which underscored the pivotal roles of Sluggers hotshots Ira Streicher and Nikka Francisco, came just a week after the black-jerseyed team ran down Unicorn in an 83-42 juggernaut powered by topscoring Streicher, Francisco and Jho Marquez. “Streicher played only twice this season,” tournament organizer Gil Pagunsan told The SUN. “Hopefully, (she’ll play again) in the championship at malaking advantage ang height,” he added. President Benigno Aquino III, in a public address broadcast on national television stations on January 28, said he knew about the police operation that left 44 well-trained SAF members dead in the hands of Moro Islamic Liberation Front (MILF) and Bangsamoro Islamic Freedom Fighters (BIFF) in Maguindanao. In his public address, Aquino said instructed SAF Police Director Getulio Napeñas to coordinate with the concerned groups, but lamented that the police had “very minimum compliance.” Interior Secretary Manuel Roxas II earlier considered the incident a “misencounter” between the SAF and the MILF. Reports said 392 SAF troopers were on their way to arrest Abu Marwan, a Malaysia terrorist, and bombmaking expert Abdulbasit Usman who were both connected with the President Aquino addresses the nation. Bangsamoro Islamic Freedom Fighters (BIFF). Aquino said Marwan and Usman were not ordinary criminals, noting that Usman has at least eight outstanding arrest warrants and about two for Marwan. The President, in his televised address, said he repeatedly reminded Napeñas, who had been relieved of his post, about the need to coordinate with concerned authorities. Junjun Binay released but loses chance to dispute charges The Senate Blue Ribbon Subcommittee arrested Makati Mayor Jejomar Erwin Binay Jr. last Jan. 29 for contempt, but released him from detention three hours later. “Since the order of arrest has been satisfied, your manifestation (not to answer questions) is noted. You lose your chance to give your side, you are free to go,” said Senator Aquilino Pimentel III during the hearing. This punctuated his continued refusal to answer questions from the panel looking into allegations of corruption against him, other city officials and his father Vice President Jejomar Binay. But Pimentel said Binay’s belief that the subcommittee didn't have jurisdiction to compel him to answer questions related to the inquiry was contrary to the panel's position, and indicated that it was time to elevate the issue “to a referee” that would decide which position was according to law. The senator then suspended the session and set the next hearing on February 12. On the motion of Sen. Antonio Trillanes IV, Pimentel ordered Binay to be brought to the session hall from the office of the Senate Sergenat-at-Arms where he was holed up when he refused to face the subcommittee. Binay, incumbent city administrator Eleno Mendoza, and former city administrator Marjorie De Veyra were brought to the hall by the sergeant at arms. Pimentel said the purpose of the arrest fn the three was to bring them to the session hall to attend the hearing. Lawyer Claro Certeza opposed the order saying his clients were unwilling to come to the session hall. Binay’s supporters at the gallery howled when they saw the mayor being brought to the session.— With a report from GMA News Binay accused of getting P200M kickback from Boy Scout deal Vice President Jejomar Binay, longtime president of the Boy Scouts of the Philippines (BSP), stands accused of pocketing around P200 million in kickbacks from a deal between the BSP and Alphaland Corp. for the development of a one-hectare prime property in Makati City. This was the latest accusation from former Makati City Vice Mayor Ernesto Mercado. Alphaland Corp. , a real estate development company, is owned by businessman Roberto Ongpin, a former trade minister during the Marcos regime. Mercado said Ongpin mortgaged the property on Malugay Street and Ayala Avenue Extension to the state-run Development Bank of the Philippines (DBP) in 2010 for P1.7 billion to finance its development. To date however, the BSP has yet to get hold of its share from the development of the property to Alphaland Makati Place, a residential and leisure complex, Mercado said. The complex consists of prime properties The Residences, The City Club and Makati Place Mall. The camp of the vice president denied Mercado’s allegations that Binay got P200 million in commission from the land deal. Lawyer Rico Quicho, Binay’s spokesman, said that the vice president was “not personally involved in the transaction between Alphaland and the BSP.” Mercado promised to present evidence on the anomalous transaction when the Senate blue ribbon subcommittee hearing resumes its public hearings on the anomalies involving Binay. He said threats from Alphaland president Mario Oreta prompted him to expose the anomalous transactions. “I had no choice, but in order to protect myself and the BSP, I shall see to it that the public is informed of what I know about this,” he said. The SUN February 2015 5.5M Filipino kids in child labor Some 5.5 million Filipino children are forced to work at young ages, with more than half of them trapped in the “worst forms” of child labor in environments considered as hazardous. In a forum on Ending the Worst Forms of Child Labor in the Philippines on January 28, European Union Ambassador Guy Ledoux said that while the government’s efforts to eradicate child labor has been encouraging, much remains to be done. “There is certainly a lot of work and challenges ahead as there are still 5.5 million Filipino children engaged in child labor, with 3 million of them trapped in the worst forms of labor,” Ledoux said. “I note that there is now in place a ‘Convergence Program against Child Labor’ which aims to create child labor-free communities by harmonizing the support systems at the local level,” he said. According to a 2011 report by the International Labor Organization, as many as three million children work in environments that are considered hazardous, and an additional 2.5 million forced to work in slightly better but still substandard conditions. Most child labor occurs in the informal sector, with about 60 percent in agriculture and domestic service. Although the law mandates free education, many children do not attend school because the costs of books, uniforms, meals, and transportation are prohibitive for many families. Some children have jobs that place them in immediate physical danger. These risks include exposure to potentially harmful chemicals or sharp tools, and other dangers that may be less obvious but no less risky. Children are often forced to work long hours with few breaks, which takes a toll on their physical development. Others are abused by their employers, both physically and psychologically. Although some companies make use of both boys and girls in their operations, boys remain at higher risk of becoming child laborers; almost 67 percent of child workers in the Philippines are boys. Hazardous work involving children is most prevalent in the Central Luzon, Bicol, Northern Mindanao and Western Visayan Island regions. Social Welfare Secretary Corazon Soliman appeared before the Senate committee on social justice on January 27 and tried to justify the rounding off of some 100 families living along Roxas boulevard in the cities of Manila, Paranaque and Pasay and brought them to an airconditioned resort in Nasugbu, Batangas as part of the preparation for the visit of Pope Francis to the country. The six-day event, which was timed while Pope Francis was in the Philippines, cost P4,750,223. Nancy Binay. She said it was part of the DSWD’s program geared toward providing street families activities involving character-building and personal development. Soliman said the DSWD has been doing similar activities since 2011, citing its first activity in August 2011 at the Manila Boys Town complex in Marikina City with 145 street children participating. It cost the DSWD P585,000. The second was held in December 2011 at Villa Diaz Resort, with 127 street children, costing P180,000. The families were registered as beneficiaries under the modified Conditional Cash Transfer (CCT). She explained that the activity was part of the “family camps for homeless family” which was meant to protect them from hazards and exploitation. It was also a chance, she said, to give homeless families social services while at the camp and allow them to also experience new things. The other similar activities were held in May 2012, under the Pamilyang Pilipino Tanging Yaman ng Lipunan Family camp that involved 102 street families from Manila, Paranaque City and Pasay City. SWS survey shows fewer hungry families The number of Filipino families that experienced hunger was fewer by about one million in the last three months of 2014, according to the latest survey of the Social Weather Stations (SWS). The survey conducted on November 27 to December 1, showed that 17.2 percent of adult respondents (an estimated 3.8 million households) said they experienced involuntary hunger at least once in the fourth quarter of last year, lower than the 22 percent (about 4.8 million families) recorded in the September survey. The survey, with 1,800 respondents through face-toface interviews, defined “hunger” as involuntary suffering as respondents were asked on such experience due to lack of food to eat. Survey questions were directed at household heads. The 17.2 percent hunger rate is comprised of the 13.2 percent (or an estimated 2.9 million families) who experienced “moderate” hunger and 4.1 percent (an estimated 888,000 families) who experienced “severe” hunger. Moderate hunger refers to those who experience having nothing to eat “only once” or “a few times” in the last three months, while severe hunger pertains to those who experience it “often” or “always” in the last three months. Last year’s average hunger rate, however, was just 1.2 points lower than the 19.5 percent recorded in 2013. But it was the lowest annual result since 2007’s 17.9 percent, the SWS noted. “Moderate” hunger fell by 4.4 points from 17.6 percent (an estimated 3.8 million families) in December, while “severe” hunger dipped by a nearly flat 0.3 of a point from 4.4 percent (970,000 families), the survey said. The few who did not state frequency of hunger were counted in the “moderate” category, it said. The country’s hunger rate improved across geographic areas, the SWS said. Synchronizing polls set Postponing the Sangguniang Kabataan (SK) election scheduled in February and synchronizing it with the barangay election in October 2016 would generate savings of P900 million, according to Commission on Elections (Comelec) outgoing chairman Sixto Brillantes. “If we conduct these two elections, we will be able to save the money – the reason we are pushing for a postponement of SK,” he said. The Senate approved on January 23 the bill synchronizing the SK and barangays elections after Brillantes justified the poll body’s proposal for the postponement of the SK balloting. Brillantes said that proceeding with the SK polls would only interrupt preparations for the local and national elections set in May 2016. Erap beats disqualification case Questions about the eligibility of Manila Mayor Joseph Estrada to give the presidency a second try have surfaced following his victory in the Supreme Court case seeking his disqualification. The Supreme Court en banc on January 21 junked petitions questioning the constitutional basis of Estrada’s candidacy in the 2013 local polls as it recognized that the former president was granted absolute clemency by then President Gloria Macapagal-Arroyo shortly after he was convicted of plunder by the Sandiganbayan in 2007. Voting 11-3, the high court dismissed the disqualification cases filed by lawyer Alicia-Risos Vidal and former Manila Mayor Alfredo Lim, questioning the validity of Estrada’s victory in the May 2013 elections. The ruling, penned by Associate Justice Teresita Leonardo-de Castro, upholds the Commission on Elections decision to dismiss Vidal’s case against Estrada. The petitions argued that Estrada should not have been allowed by the Comelec to run for public office after having been convicted of plunder. Supreme Court spokesperson Theodore Te said the high court’s ruling last week pertained only to the disqualification case of Estrada as Manila mayor, and not his eligibility to seek the presidency again. Estrada ran in the 2010 presidential elections and placed second to Benigno Aquino III. The question on Estrada’s eligibility to run for office was raised in 2010 but the Supreme Court dismissed it for being moot because Estrada did not win anyway. Part of the condition for his pardon in 2007 was a promise that Estrada would not seek public office again. Jinggoy jail transfer sought The Office of the Ombudsman is asserting that Senator Jinggoy Estrada should be transferred to the Camp Bagong Diwa in Taguig City. In a petition to the Supreme Court on January 27, the Ombudsman said Sandiganbayan has abused its discretion in denying its earlier motion for Estrada’s transfer. Estrada is facing a non-bailable case of plunder and 11 counts of graft in the Sandiganbayan Fifth Division for alleged misuse of his Priority Development Assistance Fund (PDAF) by funneling it to funneled to inexistent or faked non-government organizations (NGOs) linked to alleged PDAF scam mastermind Janet Lim-Napoles. Just as we thought victory was in the bag for a group of OFWs fighting an illegal placement fee case against one of the most entrenched employment agencies in the Philippines, we got word that an appeal was filed. The complainants received the notice of appeal late last month, although it was filed on Nov. 25, barely a week after POEA ruled in their favor. Quite frankly, it did not come as a surprise. The agency, Findstaff, could not have given up so easily after 42 years of an apparently lucrative operation. But repeated assurances from one of the OFWs following up the case in Manila that no appeal had been filed within the prescribed time did perk up our holiday spirit. It turned out the agency did not waste time asking POEA to reconsider its decision, but went directly to the Labor Secretary with an appeal. The grounds for the appeal were as expected. Findstaff reiterated it was its Hong Kong counterpart, Satisfactory Employment, which demanded $21,000 from their joint recruits. The Manila agency also pointed out that the complainants themselves said it was Satisfactory that collected the illegal fee, and only remembered to drag Findstaff into the fray in their supplemental affidavits. The OFW complainants, who celebrated the Christmas holidays with the happy thought that they would soon be getting the money that they were forced to cough up, were crushed. It was not so much the long wait ahead that bothered them, but the thought that they needed to have additional resources, if they must press their quest for justice. The early part of their campaign moved along unexpectedly well, when they What is ‘Section Juan’? I thought answering the question would be easier once we’ve established ourselves as an association. The truth is (and I like to be as honest and transparent as I possibly can with these things), we’re still far from being established, though we already have 21 members and could confidently say that we are making a mark. But being recognized as a society was just the first step. And I’m glad we took the first step because without it, we wouldn’t be “the pioneer peer support group for Filipino youths in Hong Kong”. But here’s the Herculean task (and answer) to that simple question. This support group (association) stemmed from the “bones of a fish” Ben Bernardez, who is now Section Juan’s documentations and publications head, “cooked up” while I rattled in the wind, cursing the vicious cycle many of our Hong Kong-raised youths have been wired in. It was after we had been invited to the Philippine Education Fair Ambassadors in October 2011 (thanks to Victor Bautista, one of the former presidents of the now decade-old University of the Philippines Alumni Association HK Chapter) that the sweet cookie of that reality crumbled – “Oh em gee. What’s after this? We DO NOT have a support group for our youths. At all.” The pregnant silence made us sink in our chairs. I didn’t know what my peers were thinking that time, but from the way our brows furrowed all at the same time, and from the blank stares we gave each other, I knew we were on the same wavelength. As soon as I recovered, the first words that I managed to utter were, “We must do something”. Little did I know then that this “something” would take us five years. But, borrowing the words of Pope Francis in his recent trip to be with the survivors of Haiyan in Leyte: “I am here to be with you. Faced with a Senate resolution calling for an urgent investigation, POEA took no time in letting the axe fall on Findstaff. But after the case was elevated to DOLE, the complainants found themselves on their own again, save for the constant presence of their church leaders. They needed a lawyer to help them, and fast. But, they knew it would cost. They turned to a lawyers’ group supposedly offering free legal assistance, but were told to just sit it out. It became obvious then that they needed money to get things to move quickly. Just when they thought they were running out of options, luck smiled at them again. Through a referral, a top- notch lawyer agreed to draft posthaste their opposition to the appeal, for free. They were saved again, just in the nick of time. During this last consult, the OFWs were told they could be facing a long wait, since there is so much at stake for the losing party. The case could move from DOLE to the courts, where it could languish for years. On the other hand, they could be offered a compromise they might find hard to decline, given the long wait that may still lie ahead. The OFWs insisted they will not compromise. But that could mean, scrounging for help again, should the latest goodwill that has been extended to them dries up. And so the waiting game begins again. I have a place near the municipal road. I really need your help because I hate to go abroad and be far away from my family. I would really appreciate if you could help me or give advice. I have a lot of interests, like running a computer shop, dog breeding, gym exercises, that I am passionate about. But I don’t know if these can be turned into a profitable business. Honestly sometimes I compare myself to others. I have a place and money to do business but I am so jealous of people who can run a business but I can’t because I don’t know what I should do. Then I saw you on TV and immediately idolized you. I want to be a businessman like you so help me to develop my business skills. Migrants’ Forum lie in Hong Kong itself. There aren’t enough storytellers from our community as well. Admittedly, Section Juan has been met with various challenges over the past few months, internally and externally. But each time we officers meet, amid our tight schedule of juggling jobs, parenthood and school, we create a refreshing experience through our ‘no-holds-barred’ exchanges. We are enlightened by our differences and ignited by our diversity, so we stay. But beyond that, we find more reasons to hold on, more than the ones we have for letting go. Because at the end of the day, we Filipino youths matter. Our children matter. They are worth each second of our time. Our children and youth need our support. Who else will put a stop to the vicious cycle of us not getting enough opportunity in our adopted home if we are not encouraged to speak and take action? Our group also shares opportunities with those who have yet to discover the world yonder, or explore beyond what they have been accustomed to. Section Juan, without having to parade the colours of the Philippine flag, is to be the “classroom” between school and family. We believe that being a Filipino is international enough as it is, like being American, British, Spanish, Canadian and what have you. This is especially true in a place like Hong Kong, which prides itself as a melting pot of international cultures, but has fallen behind in acknowledging the contribution of its largest nonChinese population, the Filipinos. I have asked scholars, historians, academes, veteran journalists, writers, students, teachers, long-time residents, OFWs, former OFWs, government officials, etc how much they knew about Filipinos and their history in Hong Kong, and I did not get clear answers. But the fault does not only My reply: Many equate “passion” for “interest.” Those two words are very different. Passion means something that you can hardly control, and that you will practically die if you do not indulge in that particular activity. Interest on the other hand is just some liking or wanting to learn about something. It is unlikely that you can have a passion for many things. Looking for a business in relation to something that you are interested in is almost the same as looking for a business in relation to what you are passionate about. The fundamental fact is that every business must continually satisfy a need or demand for a product or service. Without this demand or market, there can be no business. The challenge is to determine what need or demand is there where you live or operate in. There are very rare exceptions when an entrepreneur (like Steve Jobs) creates a demand by his own passion in creating demand. Looking for a business could start with your own assessment of what it is that you are passionate about and finding out whether or not this passion could result in producing products or services that many would be willing to pay for. Alternatively, you could look around your own community and see what is it that the people there need or demand that are not available at the price they can afford. If you find such potential product, ask yourself, if you have sufficient interest to engage in it, and whether you have access to the technology and skills needed to produce it. Only then will capital considerations come into play. The situation of PP is common to most people. They assume that before one can look for any business possibility, they must first have capital. I have always believed that an entrepreneur with a sound business idea and plan will always be able to raise the necessary capital. Capital does not determine what business to get into. Rather, defining the business determines the amount of capital Note too that developing your business skill does not happen overnight. It takes a lot of study, analysis, patience and experience. If you have read my books, you will learn that I went through very many trials. Other people I write about also went through so many trials. You are not 25 alone and it is best that you are not jealous of others. Instead develop yourself through education so that others will admire you eventually. Mula sa pagiging isang maliit na siyudad na napalilibutan ng tubig, ang lupain nito ay lumawak nang husto sa pag-usad ng mga taon dahil sa pagsakop sa dating dagat, at ngayon ay napapalibutan ng matatayog na gusali na tila humahalik sa mga ulap. Nguni’t sa ating pamamasyal sa mga suluksulok ng lungsod, makikita pa rin natin ang ilang lugar na makasaysayan at nagdaragdag-kaalaman tungkol sa dating buhay dito sa Hong Kong. Ang isang halimbawa ng lumang kultura na nakaligtas sa modernisasyon ng siyudad ay matutunghayan sa Tai Hang. Sa bungad pa lamang ng Tung Lo Wan Road at Wun Sha Road ay makikita na ang magarang templo sa ginta ng sanga-sangang mga daan. Ang templong ito ay ang Lin Fa Kung, na ang kahulugan sa Ingles ay “Palace of Lotus Flower”. Ang Lin Fa Kung ay idineklara ng Antiquities Advisory Committee ng Hong Kong noong 1986 na isang bantayog at natatangi ang arkitektura. Ito ay isang templo ng Buddhist “bodhisattva” na si Kwun Yum (Goddess of Mercy), na sinasamba at dinadasalan ng sinumang gustong humiling ng kaligtasan, awa, o kababaang loob. Ayon sa alamat, si Kwun Yum ay nakikitang nakaluklok sa isang malaking baton na napapaligiran ng mga bulaklak ng lotus habang nag-aaral ng pagtuturo. Ang malaking bato na ito na tinaguriang “Lotus Rock” ay matatagpuan sa itaas ng altar ng templong ito. Pinaniniwalaan din na ang mga tumakas mula sa Silangan ng Tsina noong panahon ng Taiping Rebellion ay nanirahan sa Tai Hang, at dito nila itinayo ang templo ni Kwun Yum nang pagpalain niya ang mga naninirahan dito. Ang templo ng Lin Ka Fung ay itinayo noong1863 sa gilid ng bundok, at nakaharap sa dagat sa gawing kanluran. Sinasabi na noong unang panahon, tuwing “high tide”, ay makikita na umaagos ang Ni Jo Campos Ang templong Lin Fa Kung o “Palace of Lotus Flower”. Ang dragon na ito ay pinaglaanan din ng malaking taunang pagdiriwang sa Tai Hang na ginaganap ng tatlong araw simula sa bisperas ng MidAutumn Festival. Tampok sa pagdiriwang ang Fire Dragon Dance, isang parada ng daan-daang tao na may dala-dalang isang mahabang dragon. Ang 67 metrong haba ng dragon ay gawa sa yantok, lubid na abaka at uhay ng palay. Ito ay tinutusukan ng libu-libong umaapoy na insenso at dala ng halos 100 katao sa parada. Kasabay nito ang parada ng makukululay na parol na may ilaw at dala-dala ng mga batang may magagarang kasuotang Tsino, at tumatagal nang ilang oras sa pag-ikot sa mga kalye ng Tai Hang. Ang ritwal at pagdiriwang na ito, ayon sa isang alamat, ay isinasagawa taun-taon may isang siglo na ang nakararaan. Ayon sa alamat, isang malakas na bagyo at salot ang dinanas ng mga naninirahan sa nayon ng Tai Hang. Upang itaboy ang salot na ito ay gumawa ang mga mamamayan ng isang malaking dragon na may umaapoy na katawan. Sa kalaunan ay naging tradisyon na ito ng mga Intsik sa Hong Kong at ginaganap ang pagdiriwang taun-taon. Xyza Cruz Bacani, the Filipina domestic helper who sneaks out at night to take dramatic shots of Hong Kong after dark, has been named one of the scholars of the prestigious Magnum Foundation, and will study at the Tisch School of the Arts at New York University. Xyza, 28, first gained recognition when she was written about in the highly regarded New York Times for her edgy shots. Catalla also announced future activities, like bringing back the Madrigal Singers to Hong Kong, after their wellreceived performance here last year. Another project is to bring the annual diplomatic cocktail reception for Philippine Independence Day to the University of Hong Kong so more people could attend. The first time on the issue on Jan 15 at the induction of the new officers of the Philippine Association of Hong Kong, Congen Catalla said she did not want to dignify the accusation of the critic, who uses the name “AIAS HK” on the social media site. “Kung may narinig kayo na ako ay sinisiraan…I’m sure hindi naman kayo naniniwala dyan…I don’t want to elaborate, and I don’t want to dignify what that person said, but whatever she said, walang katotohanan..Basta trabaho lang tayo”. At a later meeting held at the Consulate on Jan. 25, Congen Catalla again hit out at the disgruntled critic. “Hindi po ako nagsasalita kahit kanino, hindi ako nagkukuwento kahit kanino. Wala akong FB pero dumating sa akin na may mga taong nagsasabing ngakngak ako ng ngakngak, palengkera ako. Hindi ko ho pinansin yun. I don’t want to dignify such allegations by a certain person. Ayoko nang idescribe kung anong klaseng tao siya…” Congen Catalla said she has never spoken publicly about the case, and has not even followed up with the departments concerned on what they intended to do with the report. But she was adamant she did what she had to do after receiving a formal request for an investigation into the case. In the report, former Labatt Roldan was found to have allowed his then driver, Donald Retirado, to set up an employment agency while employed by the Department of Labor and Employment, in violation of civil service law on conflict of interest. The fact-finding committee also noted an obvious tampering of Retirado’s contract, in an apparent attempt to show he was no longer under DOLE’s employ when his agency was given accreditation by Roldan. Blasting at the committee report and The SUN’s article on it, the FB critic hinted that a big lawsuit for defamation could be brought by Retirado against Congen, this writer, acting labor attaché Marnie German and Adrielle Panares of the Coalition of Service Providers for Ethnic Minorities, which initiated the complaint. The former barrister also mistakenly asserted that Retirado could call the police for help in fighting his case. Retirado, apparently emboldened by the advice, sought to get Congen and three other people, including this writer, to apologize and resign over the committee report and the subsequent publicity that it got, but was ignored. As Congen wryly noted at the community meeting, “Ako ho nandito pa rin ako, nandito pa si Atty Mandap, nandito pa si Atty Marnie, nagta-trabaho, at wala pa ho kaming natatanggap na summons mula sa korte. She is also known for her firm resolve, as shown by her record of being the first in line for the overseas voting for Filipinos in Hong Kong for four straight years. She is Rowena de la Cruz, the current vicechairperson of GabrielaHong Kong and secretary- general of Bayan-Hong Kong and Macau chapters. What may not be as obvious about Rowena is that she is passionate about cooking, and good food. But although she came from a family of good cooks, Rowena was at first not keen on learning how to cook. She did have an early start in the kitchen, though, as a helper to her father who was so meticulous about cooking he insisted on vegetables being cut or sliced a certain way. “I remember my father would scold me when I did not slice or cut the vegetables to his standard.” Rowena says, recalling her early days back home. Rowena’s father is a trueblue Capampangan who lived up to his native province’s reputation for culinary excellence. He was often hired to cook for banquets or fiestas in barrios around San Pablo City where the de la Cruz family resides. To do this, he would sometimes spend a few days off work as he would be in charge of the food preparation, from butchering a pig or cow, down to preparing and cooking all the dishes for the feast. Rowena’s mother, who is a native of San Pablo City , is no stranger to cooking either, though her specialization is desserts and merienda fares like native rice cakes. Remove the gills and innards of fish, then wash thoroughly under running water to remove blood from the fish. 2. Break and twist the tail. Pull to remove tail completely. 3. Slice the fish vertically on each side and sprinkle a generous amount of salt. Using the palm of your hand, press firmly to flatten the fish. This process will ensure that the fish will be cooked evenly and the ingredients will be absorbed. 4. Peel and crush garlic, peel and slice shallots and ginger. 5. Wash and cut green mustard. 6. Slice pork belly in thin strips. 7. In a pan, lay pork belly at the bottom, add half of the crushed garlic, ginger, shallots and kamias (if available) or use vinegar. 8. Arrange fish side by side and sprinkle some salt and pepper. 9. Add the remaining condiments and pour water enough to cover the fish. 10. Bring to a boil and reduce heat. 11. Leave to simmer for 30 minutes until the liquid is reduced. 12. Add coconut milk and chilies. 13. Continue to simmer till the coconut milk thickens and the fat from the pork and coconut milk are well blended. 14. Add green mustard and simmer till cooked. Kulawo Ingredients: 1 pc Eggplant 1 pc Onion 1 Large Tomato 1 Siling Labuyo Procedure: 1. Roast the eggplant over fire until cooked. 2. “Burn” grated coconut in hot coal, then squeez it to produce a creamy coconut milk. 3. Boil the coconut milk with vinegar to serve as sauce or dressing for the grilled eggplant. 4. Combined with sliced onions, tomatoes and chili. The SUN February 2015 31 Feb. 10 is judgment day in Erwiana abuse case By Vir B. Lumicao A District Court judge has set Feb. 10 as judgment day in the case of abuse filed against the former employer of Indonesian domestic worker Erwiana Sulistyaningsih. Judge Amanda Woodcock set the date of verdict after accepting closing submissions from both the prosecution and defense on 20 charges of physical abuse and nonpayment of wages and statutory holidays against Hong Kong housewife Law Wan-tung. Courtroom No. 25 was packed as journalists and supporters of Sulistyaningsih competed for space at the resumption of the hearing on Jan. 20 following a sixworking-day recess to give the two sides time to prepare their final submissions. Law, 44, has pleaded not guilty to the charges of inflicting grievous bodily harm on Sulistyaningsih, and for ill-treating two previous Indonesian maids, Tutik Lestari Ningsih and Nurhasanah. In summing up, prosecutor Louisa Lai said it was hard to determine when the injuries were inflicted, but said it could be concluded that Sulistyaningsih was enslaved by Law. “The defendant was never satisfied with her work. The question was why did it take seven months for her to send her away? This certainly defies common sense. The only explanation was that Erwiana was treated like a slave, an unpaid slave,” Lai said. Lai assessed Sulistyaningsih’s evidence, saying the maid was a “reliable witness”, as opposed to the defense claim that her evidence was “unsatisfactory and exaggerated”. Lai cited corroborative evidence given by medical experts and doctors who examined and treated Sulistyaningsih’s wounds after she was sent home by Law to Indonesia, as well as evidence made by two previous Indonesian maids who worked for the same employer. “The medical experts who examined Erwiana said her wounds could not have been self-inflicted,” said Lai, adding that evidence on the assaults inflicted Law “is not limited to the charged acts but other uncharged acts.” The lawyer cited in her final submission Sulistyaningsih’s claim that since the first assault, “the abuses took place nearly on a daily basis”. Defense counsel Graham Harris QC said “the evidence of Erwiana is unsatisfactory... so exaggerated as to impact on its truth”. “Your honor, we call for a fair and impartial consideration of Erwiana’s evidence because of the discrepancies and inconsistencies in her evidence,” he pleaded. Harris, who at the start of the hearings insinuated some unnamed people were financing Sulistyaningsih’s decision to take Law to court, also suggested that some outsiders with an agenda were manipulating the maid. “It is our suggestion that there could be an agenda behind this case,” said Harris, as he urged the court to be “on guard to protect against hidden agendas.” During the hearings that began on Dec. 5, the court heard allegations of torture, grave threats, detention and non-payment of wages, from Sulistyaningsih. The prosecution said its witnesses, including medical experts, corroborated the allegations of physical abuse made by the Indonesian woman. But the defense countered that the medical opinions, “view(ed) with an open mind and in a balanced way,” could even be supportive of the defense case. $0 Agent Fee! Harris’ submission said medical doctors explained the marks and wounds on Salustyaningsih’s exposed hands and feet “were from dermatitis, probably with secondary infection” and the dark colors around her eyes could be due to insufficient sleep. Ngayon na balik Phuket siya ay masaya na naman siya, lalo at mababait din ang kanyang mga bagong employer, kasama niyang muli ang mga kaibigan, at may sariling tirahan. Ika-anim pa lang ng umaga kinabukasan ay nasa pila na siya kaya naman pang-23 ang tag na nakuha niya. Gayunpaman, balisa pa rin siya habang naghihintay dahil lumipas na ang takdang oras na nakalagay sa hawak niyang tag pero hindi pa rin natatawag ang kanyang pangalan. Para namang nananadya ang mga kasama niyang naghihintay dahil sari-sari ang opinyon ng mga ito. A hospital doctor who treated Dalisay’s injuries described the burns as “third degree 6 percent”, which means three layers of her skin were burned. Sobbing motorbike meddler fined $1,000 By Vir B. Lumicao A Filipino resident who was sobbing loudly during his sentencing for tampering with a motorcycle on Jan. 16 has avoided a jail sentence but was fined $1,000 on. Christopher Moya, a 40year-old casual waiter and salesman, was convicted on Jan 2 of tampering with a parked motorbike in Central last July. He had been crying unabashedly even before Deputy Magistrate Winston Leung Wing-chung appeared in court, and had to be pacified by his mother and another relative. Moya stopped when he realized the magistrate would not send him to jail. The defense lawyer said the probation officer’s report had no adverse recommendation for the convict, and that a medical report showed Moya had suffered from memory loss. The defense counsel said the man was also reported to be talking in his sleep. Leung asked the defense counsel if there were any other problems, as he noticed Moya was “too emotional” when he came to court. The magistrate said there was a clear evidence of tampering in the case, but the convict showed remorse for his action, so he was not imposing a custodial sentence. “Considering your financial situation, I fine you $1,000,” the magistrate said. He said half of that amount would be taken from the $500 bail that Moya had earlier put up for his temporary liberty. Moya was arrested at dawn on July 21 after he tried to open the disk lock of the front wheel of a motorcycle that its owner, a certain Mr. Lai, had parked at Queens Road. Failing to open the lock, he left and returned about five minutes later with a bunch of keys that he used in an attempt to start the vehicle’s engine. Lumicao A District Court judge will announce on Feb. 12 his verdict on the case of a Hong Kong woman accused of chopping the ring finger of her Indonesian maid nearly a year ago. Judge Gary Lam made the announcement at the end of a two-hour hearing on Jan. 27 of the case of wounding with intent against Ngan Suk-wai, 39, a resident of Pokfulam Gardens and manager of a dental clinic. Before the announcement, defense counsel Adonis Cheung Kam-wing vigorously defended the accused in his lengthy final summation, insisting that the maid, Anis Andriyani, must have cut her own left ring finger, but laid the blame on Ngan. He said the maid could have done the cutting, which almost severed her finger, in order to have a reason to terminate her contract with Ngan just six days after she began working for the family on Feb. 19 last year. Andriyani sat quietly beside supporters in the courtroom gallery just a few feet away from the accused’s husband and daughter as the defense lawyer demonstrated with his hands to explain to the court his own view of what transpired on Feb. 24 last year. The defendant also listened intently from the dock as her lawyer took up about an hour discussing in Cantonese his closing argument. Only four members of the press covered the last hearing as it was held in Cantonese, unlike that against the employer of Erwiana Sulistyaningsih, who was also accused of abuse. At first, she would call up her father or a brother who is also an excellent cook, for advice. Later, she began researching online for dishes she wanted to cook herself. When she took over the leadership of an organization, her skill and love for cooking were put to a test. She found herself helping to feed up to 100 people with a budget of just about $20 per person for simple parties organized by the Bethune House Migrant Women’s Refuge. Then, for other big events like the overseas voting campaign, she often helped coordinate a potluck lunch. “Sometimes we would end up with all kinds and variations of pancit brought by different groups from different regions,” she says. “I have my own way of cooking that dish too. Basically the main ingredients are all the same, the only difference is how the pancit is seasoned.” To prevent such duplication, she coordinates with the different groups on what dishes each could bring. She admits that it is exhausting work, but says she finds it “very fulfilling”. Rowena the cook is partial to Filipino food, but with a twist. She loves experimenting with ingredients so her dishes come out slightly different from those cooked the conventional way. “When I try new dishes, I carefully savor the taste of a particular dish and then I cook my own version of it that turns out to be good, too,” she explains. Like all good cooks, she shuns pre-mixed or instant mixes, and never adds flavor enhancers such as MSG or chicken powder, saying these alter the taste of the food. Her specialties like ginataang tulingan or sinaing na galunggong or tulingan are always a hit with friends. She has also come up with her own recipe for a San Pablo delicacy called ‘kulawo’. This simple-looking eggplant dish or dip comes with a sauce that is quite complicated to prepare. It involves “burning” grated coconut in hot coal, then squeezing it to produce a creamy coconut milk, which is then cooked with vinegar to serve as sauce or dressing for the grilled eggplant.
