POHNPEI STATE 2015 GENERAL ELECTION TIMETABLE
PROVISIONS OF THE
ELECTION LAW 2L-158-90

EVENTS/ACTIVITIES
Section 51-S.L No. 2L-158-90
The General Election for the Governor, Lt.
Governor and the Legislature shall be held
simultaneously every four years, on the
second Tuesday in November.
Time for filing petitions: in the general
elections, nominating petitions for
candidates to elective office shall be filed
with the Election Commissioner no more
than one hundred (100) days or less than
forty-five (45) days prior to the scheduled
date of the election.
Filing fees: nomination is free of charge
pursuant to Article 6, Section 2 of the
Pohnpei Constitution
Withdrawal of candidates: if a candidate
withdraws his name within twenty-five
days before an election and the ballots
have been printed and if such withdrawal
shall require reprinting of ballots, the
Election Commissioner may assess any of
all expenses against the person
withdrawing.
If a candidate dies, withdraws or is not
qualified after the deadline of filing
nominations, a substitute candidate may
be nominated no later than 10 days before
the date of the election.
Request for Absentee Ballot-contents: the
request for absentee ballots shall be made
to the Election Commissioner in writing
not more than sixty (60) days nor less than
ten (10) days prior to the date of the
election. The request shall include any
information which will facilitate the
location of his or her election district and
the establishment of his or her right to a
ballot, and the address to which he or she
wishes the ballot forwarded

Marking and returning of absentee ballots:
thirty (30) days prior to the date of the
election, the Election Commissioner shall
send; official ballot, ballot envelops, a
covering reply envelops and affidavit
prescribed by the Election Commissioner.
The ballot envelop and the affidavit shall
then be enclosed and sealed in the
covering envelop and shall be postmarked
not later than midnight on the day before
the election-November 9
Proclamation on opening of polls: at
exactly 7:00 am, a member of the election
board shall proclaim aloud that the polls
are open and will remain open until 7:00
o’clock pm of the same day.
Poll workers: not less than thirty days
prior to each general election, the election
commissioner shall appoint a board of
election for State.
Petition for recount: the petition for a
recount must be filed within one week of
certification of the result of the election.
Recommendation by board of election:
Election Commissioner may request the
review and recommendation of the board
of election as to whether the recount
should take place. The recommendation
shall be submitted within three days after
the EC submits his request to the board.
Time allowed to make a decision (EC): the
EC shall decide on all petitions for
recounts and those submitted within ten
(10) days after receiving the petition or
within ten days after he election
commissioner has initiated a review.
Runoff elections shall be held 28 days
after the date of the election. In a runoff
election, there is no write in ballots
