Rights violations filed v. rent managers

The Fair Housing Justice Center (FHJC)
is contending that a Parkchester real estate
management firm has violated the city’s
human rights law by unfairly limiting or
outright denying housing to tenants with
rental subsidies.
In a complaint filed on December 5 with the
New York City Human Rights Commission,

Management LLC engaged in discrimination
based on source of income when it came to
potential renters.
A year-long investigation conducted by the
FHJC revealed that the defendants maintain
and enforce an income requirement on all
applicants, including applicants who plan to
pay all or a portion of their rent with a rental
subsidy.
This income requirement effectively
discriminates against applicants with rental
subsidies under the Living in Communities
(LINC) program and under the HIV/AIDS
Services Administration (HASA) program
even though the rents for many apartments
at Parkchester are within the rent amounts
allowed by these programs, said a FHJC press
release.
On one instance, a tester who indicated that
he had a disability, was unemployed, and had
100 percent of his rent paid by HASA, was
informed that he would still not qualify for the
housing because an annual income of $45,000
was required of all applicants.
The investigation also revealed that the
rental agents discriminated against individuals
with federal Section 8 housing vouchers,
by counting less than a third of the voucher
toward the applicant income requirement.
The complaint seeks damages and other
relief to stop the discriminatory practices and
bring the defendants into compliance with the
local Human Rights Law.
“Not only do the policies and practices
exposed by our investigation run afoul of the
law, but refusing to rent to households with
rental subsidies directly contributes to the
growing problem of homelessness in New
York City,” said FHJC Executive Director
Fred Freiberg. “Discriminating against
persons because of their source of income,
including housing subsidies, has been illegal
in New York City since 2008 and yet some
of the largest housing providers in this
community are still flagrantly ignoring the
law and discriminating with impunity.”

Admission is not first-come, first-served.
All applications received by the January
13 deadline are treated the same, according
to schools’ admissions priorities.

New law focuses on information after inmate deaths
T
he New York State Department
of Corrections and Community
Supervision (DOCCS) is now
required to be more responsive to
next of kin after a family member
passes away behind bars, based on
new legislation.
A bill, signed into law by Governor Andrew
Cuomo on November 28, mandates DOCCS
to respond to a deceased inmate’s next of kin or
other designated person who seeks additional
information regarding the circumstances
surrounding the death, including an original
preliminary death certificate.
Investigations by DOCCS are often not
completed until 12 to 18 months after an
inmate’s death.
In March 2016, Lonnie Hamilton died at
Marcy Correctional Facility in Marcy, NY,
and his family reported that they were not
advised of his death until May.
“Grieving the death of a loved one can
and will always be a very trying time for a
family,” said State Assemblymember Latoya
Joyner, who introduced the legislation in the
Assembly. “In some cases, if that loved one
is in custody, it could take up 18 months
before any details are offered regarding the
circumstances of their death. This new law
will help family members gain clarity by
speeding up the process by which they obtain
information, and make it easier to grieve the
loss by offering some closure and details
surrounding their passing.”
The legislation was sponsored in the State
Senate by Senator Gustavo Rivera.
According to DOCCS, there were a total of
501 inmate deaths between 2009 and 2012,
with natural causes the most frequent cause
of death.
“I thank Governor Cuomo for his support
in recognizing the rights of families and their
loved ones behind bars, as every inmate is
someone’s mother or father, brother or sister,
son or daughter,” Joyner said.
The law focuses on providing
information on inmates’ deaths.

T
his takes the cake.
Nurses and community leaders gathered
outside of Montefiore Medical Center’s
Moses campus on December 5 to denounce
what they considered inadequate staffing
levels at the hospital.
And they did it sweetly – hosting a baked
goods sale outside the hospital’s main
entrance to engage residents and highlight
staffing issues at the hospital.
All proceeds from the bake sale were
donated to Mocho Village, a Bronx-based
organization focused on the healthcare needs
of underserved communities in the Bronx.
Protestors argued that the stretched-toothin staffing of registered nurses and other
health care workers is compromising patient
care and causing overcrowding that forces
patients to be kept out in hallways.
The emergency rooms are also packed
wall-to-wall with patients, nurses said.
“These are very sick people, coughing
and bleeding right next to each other,” said
Judy Sheridan-González, an emergency room
nurse and President of the New York State
Nurses Association (NYSNA). “I remember
when this was a community hospital that put
patients first.”

Montefiore management responds that there
is not enough money in the budget to hire
more people.
“We have spoken up to management, but
we have fallen on deaf ears,” said Mary
Fitzgerald, an advocate with NYSNA. “We
don’t buy that line that there is no money. How
can there be no money, when [Montefiore] is
expanding to Westchester County, Rockland
County and Putnam County?”

nurses struggle to provide quality care.
“Every year, it seems like we’re being asked
to do more with less,” Greene remarked. “As
a nurse, we shouldn’t be considered a luxury
item that can be cut to stay within budget.”
“Montefiore has a responsibility as the
largest healthcare provider in the Bronx,” said
State Senator-elect Marisol Alcántara. “Many
of the patients you see kept out in the hallways
are poor people of color ― immigrants,
blacks, Latinos. We deserve to be treated like
everybody else.”
Montefiore indicated that during times
of high volume in the hospital’s emergency
departments, patients may be assigned
hallway beds if they meet a specific criteria
set and provide consent.
While the hospital said this practice is done
as recovering patients are discharged and
rooms are prepared to receive new patients,
nurses said that they have witnessed patients
being kept in hallways for several days.
“It poses a health risk people they have
no immediate access to a toilet, no sink, and
we can’t get them oxygen if they need it,”
Sheridan-González said.

S
traight out of Brooklyn – the
city’s video visitation program
for prisoners on Rikers Island
will, for the first time, be expanded
beyond that borough.
The program, which allows families to
conduct free live video chats with prisoners
on Rikers Island, has been hosted at Brooklyn
Public Library branches since 2014. Now,
as of January, 22 libraries within the New
York Public Library (NYPL), Queens and
Brooklyn library systems will offer video
visitation services.

Mark-Viverito, who represents the Bronx
and Northern Manhattan, said the video chats
will make it easier for families to connect with
incarcerated loved ones without making the
arduous trek to Rikers, which often requires
nearly a day’s worth of travel and waiting.
“This video visitation program will not
only decrease the burden on families, but
should also help reduce recidivism,” she
stated.
She announced the expansion on
November 30 at the 125th Street Branch, one
of three Manhattan libraries that will offer
the video chats. She was joined by fellow
Councilmembers Andy King and Jimmy Van
Bramer and, as well as NYPL and Department
of Correction representatives.
“This allows us to humanize our brothers
and sisters who get locked up, to bring our
children some sign of hope that they can stay
in touch with their parents,” said King, who
serves as the Chair of the Subcommittee on
Libraries.
Yvette Beatty has been using video chats
on a weekly basis at the Brownsville branch
since her son became incarcerated in Rikers in
2015. She said the appointments have helped
her son stay positive while living behind bars.
“It gave him more reason to be focused
and keep a positive mind, despite being in
an environment that makes people feel so
deplenished,” said Beatty, who brings her

Repurpose it by bringing it to
Lehman’s Food Scrap Drop Off location on
Monday mornings from 8 a.m. – 10 a.m. The
initiative is a joint project of the NYC
Compost Project and the Lehman College
Campus Sustainability Council with the goal
of reducing the amount of compostable waste
that goes into landfills.
This program is open to all members of the
surrounding community.
Composting is not new to Lehman. Since
late 2009, the on-site Rocket Composter has
been used to process approximately 120
pounds of food waste produced each day from
food preparation at the College. Additionally,

In addition to reducing the amount of waste
that goes into landfills, composting turns food
waste into a nutrient rich additive for soil.
“Compost is what plants need, a soil that has
a lot of organic material won’t need as much
fertilizer or pesticides,” explained Linins.
Donations will not only lessen the
city’s environmental impact but will help
nurture the natural plant life. All scraps
dropped off at the College will be turned into
compost and used throughout the Bronx, on
the Lehman Campus, in community gardens,
or as part of a compost giveaway in the spring
so individuals can bring nutrients to their own
flower or garden plots.

Gate 8 on Bedford Park and Paull Avenue.

City ramps up Vision Zero initiatives
M
indfulness matters.
As the city enters the busy holiday season
and the darkest part of the year — typically
the deadliest time for pedestrians on New
York City streets — Mayor Bill de Blasio has
announced enhanced efforts around its Vision
Zero program to curtail reckless driving.
And he is urging motorists and pedestrians
alike to pay attention.
At One Police Plaza on November 29, de
Blasio revealed that the Vision Zero Dusk
and Darkness initiative launched on October
27 would continue, noting that traffic fatalities
had declined by nearly 50 percent since that
initiative began.
De Blasio cited targeted education and
enforcement efforts for reversing the uptick
normally seen in traffic fatalities during the
fall season, which includes daylight savings
time.
Department of Transportation (DOT)
statistics indicate that fall and winter
weeknight evening hours between 5 p.m. and
7 p.m. are the most dangerous times of the
year for traffic fatalities.
“We are urging New Yorkers to keep
up their vigilance during December —
particularly during the evening rush —
remembering that a wonderful season for
shopping and being with family unfortunately
coincides with the most dangerous time of the
year for pedestrians,” de Blasio said. “Drivers
especially need to remember the danger of
driving under the influence, as well as to slow
down and turn slowly. As we have always
underscored with Vision Zero, ‘your choices
matter.’”
Police Commissioner James O’Neill said
the NYPD issued 50,000 summonses for
hazardous moving violations during the Dusk
and Darkness initiative, and had increased
enforcement for distracted driving and failureto-yield to pedestrians.
During the initiative, the NYPD has also
provided enhanced coverage at intersections
and corridors with high rates of pedestrian
injuries and fatal crashes, he said.
“But December has historically experienced
significant increases in pedestrian injuries,”
remarked O’Neill. “The NYPD will be out in
force this December ensuring the safety of all
New Yorkers.”
O’Neill said the Department would ramp
up its efforts to stop drunk driving during the
holiday season, which typically produces the
highest number of Driving While Intoxicated
(DWI) summonses.
The NYPD also announced the launch of
Don’t let holiday shopping

Traffic Stat, a reporting tool for traffic and
collision data, similar to the CompStat tool
the Department uses to share crime statistics
with the public.
“Now that the principles of precision
policing are being applied systematically
to Vision Zero, we believe you’re going to
see additional progress immediately in the
months to come,” remarked de Blasio.
Since October 27, street teams led by
the NYPD and DOT have performed
outreach to engage drivers and pedestrians
in all five boroughs.
In the past month, the Vision Zero
campaign also unveiled new ads on

In a statement, Montefiore said it
continuously monitors staffing levels to
provide the safest care for patients, and
hired 45 full-time positions in April to staff

are unexpectedly out or when patient care
warrants additional staffing,” the statement
said. “This was part of Montefiore Medical
Center’s finalized agreement with NYSNA

I
t’s best to eat hearty winter pies
such as pecan or apple slightly
warm, topped with vanilla ice
cream. Piling on scoops chocolate
just won’t work.
“The flavors would be busy in your mouth,”
says June Coleman.
She should know. Her brand, Fancy Pies,
are for sale at a pop up shop located at Le
Chéile at 181st Street uptown. The pies are
baked at Melita Bakery, located in the
Mott Haven section of the Bronx.
She has been baking since
she was 11 years old. Her first
attempt, a chocolate cake, was
accidentally put in the oven
before she remembered to add
a key ingredient. It smelled
wonderful. But it was hard as a
rock.
Her mom bravely tasted the
effort. “You tried really hard,” she
said reassuringly. “You tried.”
Since then Coleman has more than made up
for it. Her holiday pies are selling briskly.
Customers at Le Chéile can select five
different types. Nana’s Alabama Apple is a
straight-up classic apple pie. The butter-filled
crust has the consistency of a shortbread.
For people who like swankier pies, there is
the BAP’s (which stands for black American
princess) Sour Cream Apple Walnut.
There are also festive pies – among them,
the Southern Bourbon Pecan and Bourbon
Sweet Potato Pie.
“These are really complementary favors.
The bourbon lends itself well to the sweet
potato,” she said. “It balances out the
sweetness.”
Coleman thinks of pies as flavor profiles.
“It’s all about the balance of the sweetness of
the pie with the spice and the dough with the
filling.”
Her Creamy Jamaican Spiced Pumpkin is
an exciting twist on the holiday classic.
“It has fresh ginger, my secret
spice blend, and it’s finished with
Jamaican spiced rum,” she said.
Coleman describes herself
a “Rachel Ray” type of cook.
She cooks because she likes
to eat. While she grew up on
the Upper West Side ordering
bagels and lox at the deli, her
mother was a Southern-style
cook.
While other kids her age had
younger moms who were more like
friends, her mom demanded respect. “You
don’t sass me,” she’d tell her children. She
was proud when people complimented her on
how well behaved her children were. “It was
just a testament of who she was.”
Coleman always had an entrepreneurial
spirit. She baked and sold pies to raise money

became too much, and she turned to Melita.

Coleman said future pie pop up shops
are planned. Fans can find her again around
Valentine’s Day, Easter and Memorial Day.
Then she hopes to open up around Halloween
until Christmas. Those holidays will feature
other pies, such as Aunt Ann’s Tangy Citrus
Merengue Pie, made with lemon, grapefruit
and lime.

No Brakes on the Bikes
Council pushes for Citi Bike expansion

The City Council’s Transportation
Committee Chair is advocating for taxpayer
money to be used to expand the Citi Bike –
instantly recognizable by its bold navy hues
– program throughout the entire city within
the next three years.
Councilmember Ydanis Rodríguez, at a
November 28 hearing on the future of Citi
Bike, said that public funding should be
earmarked to drive growth of the popular
bike share program into the Bronx and Staten
Island, all of Northern Manhattan and deeper
in Brooklyn and Queens.
“I am setting a goal today, that Citi Bike
should be available in every community
board in the city by the year 2020,” stated
Rodríguez.
“It means that we should all increase our
contributions, with public and private capital
and expense dollars, so that New York City
can be an example to others with bike share
in every neighborhood. Working, middle and
upper class communities should have the
ability to enjoy this resource equally.”

rolling out to other parts of New York City.
“How could Citi Bike go to New Jersey
before it goes to all five boroughs?” he
asked. “Since then, I have heard from my
constituents, over and over again, that they
feel slighted by the lack of a Bronx bike

a more immediate way to connect with the
incarcerated.
“The trip to Rikers is a difficult and timeconsuming journey, and it shouldn’t be that
difficult to stay connected to the people that
you love,” he said.
“Three-quarters of our inmates return to
the community, and maintaining contact
with inmates’ families greatly aids inmates’
successful re-integration into society,”
said Department of Correction Commissioner
Joseph Ponte in a statement. “We thank the
Council, the administration and the libraries
for their continued support of this important
program, which furthers safety and justice for
all New Yorkers.”
NYPL President Tony Marx explained that
his library system has been very engaged with
the Rikers correctional facility, by hosting
“Daddy, Mommy & Me” literary services,
book carts, and a publication designed to help
recently released inmates.
“And this year, we opened the first
permanent library facility on Rikers,” he said.

Services at Brooklyn Public Library, said that
video visitation sessions are held in private
rooms designed to be welcoming for children,
which include toys and children’s books.
The same books are provided to inmates so
they can read to their children.
“This makes it possible for… families
separated by incarceration to read stories and
play games together as if they were in the
same room,” remarked Johnson.

video chat service in Brooklyn, 86 percent
had children under 12, she said.
Beatty commented that the video chat
setting is less intimidating for children than
the experience of visiting Rikers.
“The kids don’t like going to the facility,”
she said. “We prefer bringing them to the
library.”
To schedule a one-hour video chat, families
must contact the library at least 48 hours in
advance, explained Higgins.
Appointments are available Monday
through Friday.
There is no limit to the number of
appointments a family can make, said
Higgins, who added that the city is working
to add weekend hours for video chats in the
future.
“My philosophy is that we have to invest
and take the time [to help] those that are
incarcerated, because at some point, they
come back to our communities, and they
reintegrate in our communities,” explained
Mark-Viverito, who said she visits a Rikers
inmate three times per year. “And what
better way to have them be successful at that
integration than by investing in them, and
maintaining the family ties.”

An emotional King remarked that while the
video chats will help keep families together,
the city needs to do more to prevent young
men from getting locked up to begin with.
“We’ve got to stand here and figure out
how to keep our people out of prison in the
first place,” he said.

Jay Walder, Chief Executive Officer of
Motivate, agreed that city funding is necessary
to briskly expand the service.
“To achieve the goals that have been
articulated at the Council today cannot be
done without public support,” Walder said at
the hearing.
The current stage of the program, known
as Phase 2, is bringing Citi Bike into parts
of Astoria, Harlem and Crown Heights,
explained DOT Commissioner Polly
Trottenberg.
However, she said there is “no timetable”
for expansion into the Bronx or Staten Island.
The highest usage for Citi Bike occurs at
docking stations near large transit and tourist
hubs, including Central Park, Penn Station,
Union Square and the Port Authority Bus
Terminal, said Trottenberg, who pointed
out that the system has frequently struggled
to meet demand in certain areas and have
enough bikes at available at docks.
Trottenberg estimated that 70,000 to 80,000
bikes would be needed to accommodate users
across all of New York City
She cautioned Councilmembers that
expanding Citi Bike could pose challenges in
lower-density areas where the program would
not be bolstered by tourism and advertising
opportunities.
“All city bike systems follow the same
principle, which is, they want to be in dense
areas and they want to be in contiguous
areas,” Trottenberg commented. She said,

going to have more complexity in terms of
the number of riders you’re going to get,
the potential for advertising revenue, tourist

Walder told Councilmembers that Motivate
has worked to boost Citi Bike’s appeal in

noting that membership in Brooklyn’s
Bedford-Stuyvesant neighborhood shot up
50 percent after the company partnered with
a community-based organization to increase
outreach.
