Morning Session
Six CPD Points | MARA Item #WK61 | 9:00am-12:45pm
Module 1 — Advanced
Seminar/Workshop Refresher
Module 2 — Interactive
Case Study Workshops
Update on latest developments in case law,
legislative activity, policy and issues concerning
the immigration portfolio generally. The module
will examine:
Case studies based on realistic scenarios relating
to various visa subclasses and the more complex
issues encountered by agents.
• Court decisions that set precedents that must
be followed by decision-makers or which are
relevant to the day to work of the migration
professional
• Tribunal decisions that highlight matters of
general application such as approaches to
evidence, procedures, statutory interpretation
or which indicate trends in decision‑making
• Critical analysis of recent legislative and policy
developments in immigration and other areas
of law that impact on immigration
• Discussion and analysis of media commentary
and political debates concerning immigration
and the migration agent profession
The case studies will require you to work through
a solution using legislation, case law and other
relevant resources. The case studies will involve
scenarios featuring the more difficult aspects
of selected aspects of migration practice, including:
• Permanent and Temporary employer sponsored
visas (including employment law issues)
• Partner visas
• Visitor visas — sponsored and unsponsored
• Business Skills (Innovation and Investment) visas
• Family visas
• Health and character issues
• Student visas
• GSM visas
• Protection visas
• Citizenship matters
• Code of Procedure
• Visa cancellation
• PIC 4020 issues
• Section 48 issues
• Condition 8503, 8534 and 8535 waivers
• SkillSelect issues
• Unlawful applicants
• Time limits and valid application requirements
• Merits and judicial review
• Legal Professional Privilege/Agent —
client confidentiality obligations
• Ethical dilemmas, conflicts of interest
and professional discipline
Note: The morning session also includes a short 10 question quiz based upon the material covered during the session. The quiz will be fun and is designed to reinforce key learning outcomes rather than fail attendees.
Completion of the quiz allows participants to receive the six CPD Points for their Office of the MARA professional development requirements.

Four CPD Points | MARA Item #WK62 | 1:45pm-5:00pm
Module 3 — Interactive
Case Study Workshops
The session will involve various case studies
but the emphasis will be on realistic scenarios
encountered in day-to-day practice by agents,
such as:
• Dealing with difficult clients
• Handling client complaints, including those
referred to professional disciplinary bodies
and other regulators/adjudicators
Module 4 — Experiential Workshop
This is a brainstorming session that will allow
you to raise issues of concern in your own practices
for group discussion. The session will be moderated
by the presenter(s) so that it remains topical,
relevant and focussed upon delivering a practical
outcome.
This can range from “true confessions” where you
have made mistakes to venting some steam about
what irks you about working in the migration field.
• Clients affected by changes in law or policy
• Dealing with problematic decision‑makers
• Handling ethical dilemmas, conflicts of interest
and confidentiality/privacy obligations
• Dealing with the media
Note: The afternoon session has been approved by the Office of the MARA as satisfying the mandatory CPD activity requirement.
