Peter Papadopoulos Helen McCulloch Directing the Global Immigration team in Australia from EY’s Sydney office, Peter has almost 20 years’ experience in private immigration practice. Prior to joining EY, Peter was the principal solicitor of his own specialist immigration law practice and had worked as a Senior Associate at Gadens Lawyers and a solicitor at King Wood Mallesons. Helen is a Registered Migration Agent and has 20 years’ experience in all aspects of Australian immigration law and practice. She has extensive experience in all employer-sponsored visas, particularly the temporary business (work) visas and developing immigration compliance and risk management strategies for her clients. Peter has lectured extensively on immigration law and is a recognised leader in the continuing professional development of registered migration agents and lawyers throughout Australia. Having worked in the Department of Immigration for a number of years in various roles, Helen has an excellent understanding of internal policies and procedures. The module will examine: Case studies based on realistic scenarios relating to various visa subclasses and the more complex issues encountered by agents. • Court decisions that set precedents that must be followed by decision-makers or which are relevant to the day to work of the migration professional • Tribunal decisions that highlight matters of general application such as approaches to evidence, procedures, statutory interpretation or which indicate trends in decision‑making • Critical analysis of recent legislative and policy developments in immigration and other areas of law that impact on immigration • Discussion and analysis of media commentary and political debates concerning immigration and the migration agent profession The case studies will require you to work through a solution using legislation, case law and other relevant resources. The session will be moderated by the presenter(s) so that it remains topical, relevant and focussed upon delivering a practical outcome. This can range from “true confessions” where you have made mistakes to venting some steam about what irks you about working in the migration field. • Clients affected by changes in law or policy • Dealing with problematic decision‑makers • Handling ethical dilemmas, conflicts of interest and confidentiality/privacy obligations • Dealing with the media Note: The afternoon session has been approved by the Office of the MARA as satisfying the mandatory CPD activity requirement. Completion Requirements Only registered migration agents (RMAs) with at least three years experience as an RMA are eligible to attend and earn MARA CPD points. Eligible participants must attend 90% of the time allocated to the session for which they have registered. In addition, eligible participants enrolled for the morning session only or the entire day must pass a 10 question quiz in order to earn the applicable CPD points for the morning session. The quiz is held at the end of the morning session and is open book and simply designed to reinforce the material covered during the morning session.
