INTERPRETATION In this Manual, the following words and expressions have the following meanings: “Act” the Promotion of Access to Information Act, No 2 of 2000 together with all relevant regulations “Information Officer” the person duly authorised and appointed by ADT in clause 3 to facilitate or assist with any request made in terms of this Act “Manual” this manual together with all annexures thereto “SAHRC” the South African Human Rights Commission 2. INTRODUCTION 2.1 The Act gives effect to the constitutional right of access to any information that is held by another person and that is required for the exercise or the protection of any rights. 2.2 This Manual is drafted to assist potential requesters with making an application for access to information or documents held by ADT. 2.3 This Manual may be amended and updated from time to time and as soon as any amendments have been finalised, the latest version will be made public. 2.4 This Manual will enable a requester to view the categories of information or documents in ADT’s possession and to follow the correct procedure when requiring access to such information or documents. 2.5 A requester must contact the Information Officer should s/he require any assistance in respect of the use of this Manual, and/or when requesting documents or information in terms of this Manual. 2.6 This Manual does not purport to be exhaustive of or comprehensively deal with every procedure provided for in the Act. A requester is advised to familiarise themselves with the provisions of the Act before lodging any request with ADT. 3 CONTACT DETAILS 3. HOW TO REQUEST RECORDS HELD BY ADT 7.1 The prescribed form attached hereto as “A” must be used to make the request for access to a record. 7.2 A request must be made to the Information Officer in accordance with the information provided in clause 3. 7.3 Sufficient detail of the request made must be provided on the request form to enable the Information Officer to clearly identify the records as well the requester’s specific identity, and positive proof of identification must be provided by the requester. 7.4 A requester must indicate which form of access is required. 7.5 A requester must indicate necessary particulars of information or documents so required. 7.6 A requester must identify the right that they are seeking to protect or that they wish to exercise and they must provide an explanation as to why the requested record is required for the protection or exercise of that right. 7.7 If a requester is making a request on behalf of another person, they must submit proof, to the satisfaction of the Information Officer of their authority to 7 make such a request. Failure to do so will result in the request being rejected. 7.8 The applicable prescribed fee as set out in annexure “B” must be paid by the requester. 8. AVAILABILITY OF THIS MANUAL 8.1 This Manual is available for inspection during office hours, at no cost at the physical address stipulated in clause 3. 8.2 A copy of this manual, or a part thereof, can be obtained from either: 8.2.1 ADT’s physical address at the prescribed fee in terms of annexure “B”; 8.2.2 the South African Human Rights Commission, whose details are set out in clause 4 above; or 8.2.3 ADT’s website as stipulated in clause 3. 9. GROUNDS FOR REFUSAL 9.1 In terms of the Act, there are certain grounds upon which ADT may refuse to grant a requester access to its records as certain categories of information may be subject to protection in the interests of privacy. Such records which may be protected would include but would not be limited to: 9.1.1 records which contain private information of a third party who is a natural person; 9.1.2 records which contain commercial information of a third party; 9.1.3 records which contain confidential information of a third party, the disclosure of which could be reasonable expected to put that third party at a disadvantage in contractual or other negotiations or to prejudice that party in commercial competition; 9.1.4 records which contain information that if disclosed could endanger the safety of an individual or if such information could impair a party’s protection of their property; 9.1.5 records which contain commercial information relating to the private body in question which would include information regarding trade secrets, financial, commercial or technical information, the disclosure of which would cause harm to the commercial or financial interests of the body; 9.1.6 records which contain information relating to the research information of a third party or of the private body in question. 8 of 10. RECORDS NOT FOUND OR THAT DO NOT EXIST 10.1 If all reasonable steps have been taken to find a record and such record cannot be found or if the record does not exist, then the Information Officer shall notify the requester, by way of an affidavit or affirmation, that it is not possible to give access to the record. 10.2 The affidavit or affirmation shall provide a full account of all the steps taken to find the record or to determine the existence thereof, including details of all communications by the Information Officer and every person who conducted the search. 10.3 The notice, as set out in clause 10.1, shall be regarded as a decision to refuse a request for access to the record concerned for the purposes of the Act. 10.4 If the record in question should later be found, the requester shall be given access to the record in the manner stipulated by the requester in the prescribed form unless access is refused by the Information Officer. 10.5 The attention of the requester is drawn to the provisions of Chapter 4 of Part 3 of the Act in terms of which ADT may refuse, on certain specified grounds, to provide information to a requester. 11. INFORMATION REQUESTED ABOUT A THIRD PARTY 11.1 Section 71 of the Act makes provision for a request for information or records about a third party. 11.2 In considering such request, ADT will adhere to the provisions of section 71 to 74 of the Act. 11.3 The attention of the requester is drawn to the provisions of Chapter 5 of Part 3 of the Act in terms of which ADT is obliged, in certain circumstances to advise third parties of requests lodged in respect of information applicable to or concerning such third parties. In addition, the provisions of Chapter 2 of Part 4 of the Act entitle third parties to dispute the decisions of the Information Officer by referring the matter to the High Court. 9 ANNEXURE A FORM B REQUEST FOR ACCESS TO RECORDS OF ADT (Section 53(1) of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) A. Fees (a) A request for access to a record, other than a record containing personal information about yourself, will be processed only after a request fee has been paid. You will be notified of the amount required to be paid as the request fee. The fee payable for access to a record depends on the form in which access is required and the reasonable time required to search for and prepare a record. SECTION 54(2) OF THE ACT Six hours are the hours to be exceeded before a deposit is payable. One third of the access fee is payable as a deposit by the requester.
