NEWSLETTER Some of A.B.A.T.E.’s accomplishments over the years: • Successfully lobbied for legislation that created the Georgia • • • • • • • • • • • • • Motorcycle Safety Program (GMSP), our state’s rider education program that is available to all. Lobbied to have legislation passed to modify the existing mandatory helmet law to allow adults age 21 and older freedom of choice as to the wearing of a helmet. Successfully lobbied for legislation leading to the repeal of the Georgia law prohibiting use of speakers or headphones while riding a motorcycle. Fought and stopped legislation introduced in the 1992 Session of the Georgia General Assembly that would have made it illegal for kids age 10 and under to ride as passengers on motorcycles. Established May as “Motorcycle Awareness and You” month through a proclamation signed by the Governor and through resolutions passed by the Senate and House each year. This is an annual effort that raises public awareness of motorcycles. Successfully lobbied legislators to approve increased funding for the Georgia Motorcycle Safety Program, in the amount of $170,000 after the license tag rate was raised on all vehicles to $20. Successfully stopped proposed legislation that would have increased the size of motorcycle tags. Successfully lobbied for handicapped tags for motorcycles without further enabling legislation, by bringing it to the attention of the Department of Revenue that the code section was written in such a way that it was already authorized. Successfully lobbied for antique tags for motorcycles in the 1998 legislative session. Established a 15 District organization that has led to more participation locally, while raising our membership statewide. The more members we have, means the more clout we have at the State Capitol. Sponsor and promote the largest Swap Meet/Bike Show in Georgia, 5 times a year. Successfully forced prosecution of a trucker who, while making an illegal turn, killed fellow motorcyclist Mark Bonner. Successfully lobbied to pass the “Frank-Lee” (ROW) bill to enhance penalties to those who cause death or serious injury to a motorcyclists by failing to yield the right of way. Successfully lobbied to pass the “Tag/Title” bill SB-437 that allows for registration of kit/assembled bikes. Signed by Governor Purdue May 14, 2008. WHAT IS A.B.A.T.E. OF GEORGIA, Inc.? The letters “A.B.A.T.E.” stand for American Bikers Active Toward Education. A.B.A.T.E. is composed of motorcyclists from all areas of the state, from all walks of life, and who ride all makes of bikes. A.B.A.T.E. is not a club, it is a non-partisan politically active organization working on motorcyclist’s rights. We are affiliated with national rights groups like the American Motorcyclist Association (AMA), the Motorcycle Riders Foundation (MRF) and the National Coalition of Motorcyclists (NCOM). Our main focus is to keep motorcycle legislation in its proper perspective. Many restrictive laws are enacted by uninformed legislators. A.B.A.T.E.’s goal is to keep our lawmakers informed of our members collective position on Motorcycle related legislation. Preventing unfair legislation from becoming law is easier than fighting to get the law repealed. Rider education and public awareness of motorcyclists are goals of A.B.A.T.E.. We are not against the wearing of helmets, and we encourage all riders to ride safely. An informed and educated rider is a safer rider. January 12th marked the opening of the Georgia Legislative session and our lobbyist Joey Brush has been down at the capital every day that they have been open working for us since. Joey reports we still need bill sponsors for several of our legislative agenda items, so district legislative coordinators, that is your queue to survey your district’s legislators and find us sponsors for these bills, the members want the bills and you as a district officer serve your members in that effect, so get on the phone type those emails and find our sponsors. So far, Joey reports we have sponsors for the Redlight bill last year’s HB869 and the Handlebar bill last year’s SB407. Georgia’s motorcyclists are depending on us, so lets bring home some new laws for them. Next I want to mention this year’s first lobby day, January 21st. 22 ABATE of Georgia members made the trek down to the capitol on a weekday to see their legislators, while I wish more had made it I salute the ABATE members who did make it. Also this year after hearing the request numerous times last year, in the tradition of Delmar Singleton himself, we brought Chili back to the capitol .Our volunteers dished out 10 gallons of Chili in 37 minutes to hungry Capitol Staffers and legislators. At this time I would like to extend a personal thanks to District Four East’s District sponsor Confetti’s for preparing the chili for ABATE at their costs, this made paying for Lobby day much easier for us as an organization. Then just last week ABATE of Georgia made our annual trek to the North Atlanta Trade center for the Great American Motorcycle Show where a dedicated group of volunteers from Districts One West, Three , Four East, Four West, Five, Five North, and one member of District Six managed tn three days hand out 500 swap meet flyers, 300 Legislative packets and unknown numbers of member apps, keys rings, rights cards and ABATE cooizies. Now our attention turns back to the capitol. We have a real chance this session to make new law for Georgia’s riders so please everyone, talk to your fellow riders, talk to your State Reps and Senators and let them know who you are and what we are fighting for and after you do that, ask them for their help. Lets make a difference this year. Also this month our State Legislative director chose to resign so we will need someone to take the position over. Please call the state office if you are interested. But, if you're really smart then you might figure out a way to buy a new motorcycle for her on Valentine's day (just kidding). However, this is one day that we should to take the time to show just how must we love our wives. In the Bible in Ephesians 5:25, it states that we are to love our wives just as Christ loved the church. In all the years that I've been married I don't think I've ever shown that much love to my wife. I know that's not a good thing but just trying to be honest. Since I started having a personal relationship with Christ, I've learned how to show more love than ever before. I still have a LONG way to go but, the point I'm trying to make is that the more that I learn how much God loves me, then the more I learn how to give that love to my wife. We need to learn how to receive love before we can give love. To be able to give unconditional LOVE to our spouses is the best Valentines gift of all. Just as God gave us that kind of unconditional love when He sent His son to die on the cross for each and every one of us, when none of us deserved it. The bible states in John 3:16, that God so loved the world that He gave His only begotten son that whoever would believe in Him would have everlasting life. God allowed His son to lay down His life for you and me. Now, that surely is a whole lot better than a box of chocolates. As I continue to grow in my walk with Christ, my love for my wife also continues to grow. But, just remember that no matter how much we love our wives, that is no comparison to the LOVE that our Heavenly Father has for us. I pray for each of you that this month and this year you will know the love of your heavenly Father in ways that you have not known before. I also pray for those of you that have not already asked Jesus to come into your hearts that you will please consider doing so, you will not be disappointed in all that God has planned for your life. OF GEORGIA, INC. NEWSLETTER Let’s talk about Lane Filtering for a second…. There has been quite a bit of confusion about what the difference is between Lane Filtering and Lane Splitting. We at ABATE hope this new infographic will better explain the difference between the two. Lane Splitting Lane Splitting is when a motorcycle rides between the lanes of traffic at speed when there is no impediment to travel and traffic is moving normally. Vs. Lane Filtering Lane Filtering is when a motorcycle rides between the lanes of traffic from behind a pack of non moving cars to proceed to a fixed point in the roadway such as a red light ahead of the cars or a right turn lane.. Filtering helps reduce traffic congestion Filtering allows the motorcyclist one more way to increase the distance between their motorcycle and other motorists Filtering allows motorcyclists to occupy road space unusable to all other motorists thereby helping reduce the amount of over all road space used by all vehicles on the road 17 February 2015 A.B.A.T.E. NEWSLETTER National and Regional News Washington, D.C.: The U.S. Forest Service has investigated four incidents in which vandals endangered the lives of motorcyclists and all-terrain vehicle riders by burying spikes along trails. The spiked strips, which resemble heavy barbed wire, can cause flat tires and loss of control, resulting in a crash. The booby traps also threaten the safety of hikers and horseback riders, and even the wildlife that travel along trail corridors. Two incidents came to the attention of the AMA in May through AMA Life Member Jerry Abboud and the Colorado Off-Highway Vehicle Coalition. The AMA then began working with COHVCO and Western states politicians to ensure the matter was fully investigated. In September, U.S. Sen. Michael Bennet (D-Colo.) wrote a letter to Forest Service Chief Thomas Tidwell citing concerns about the dangerous and illegal trail spikes. Bennet's letter was cosigned by Sens. John McCain (R-Ariz.), Mark Udall (D-Colo.) and Jeff Flake (R-Ariz.). Joe L. Meade, director of recreation, heritage and volunteer resources at the U.S. Department of Agriculture, responded to the senators on Dec. 8. He reported that the Forest Service received four reports in the past five years — two in Colorado and two in Arizona. In May, the USFS provided guidelines for anyone discovering booby traps in the trails: • Document the location with latitude and longitude, if available. • While onsite, report the device to the nearest Forest Service office: hrm.gdcii.com/directory/ • Follow the Forest Service directions. • If the Forest Service cannot be contacted, conspicuously mark the site to warn other trail users or carefully remove the device. The AMA also requests that information be emailed to [email protected]. Washington, D.C.: As a result of urgings from the AMA, the Community Preventive Services Task Force of the U.S. Centers for Disease Control is reopening its meetings to the public. In 2013, the CDC task force decided to exclude the general public from its meetings, citing a provision in the 2010 Affordable Care Act that broadened the CDC’s scope and permitted closed-door sessions. The AMA has repeatedly objected to the CDC’s expanded focus on motorcycle safety and has urged the agency to allow expert federal agencies, such as the Department of Transportation and the Federal Highway Administration, to address roadway and vehicle safety issues. Following written protests from the AMA, the U.S. Department of Health and Human Services decided in September to again allow public participation in task force meetings. The meetings are now open to those who wish to attend in person in Atlanta, or view a live webcast. Web participants may submit questions or comments. Washington, D.C.: The National Defense Authorization Act of 2015 and the so-called CRomnibus spending bill, passed by both chambers of Congress and signed by the President, include provisions beneficial to riders of off-highway motorcycles and all-terrain vehicles, but the AMA cautions that new Wilderness designations may infringe on access to public lands. The NDAA, H.R. 3979, is the comprehensive legislation to authorize the budget authority of the Department of Defense and the national security programs of the Department of Energy. The $584.2 billion bill contains more than 1,600 pages of regulations, policies and programs that authorize and govern the U.S. military. For 2015, more than 100 public lands bills were inserted into the NDAA. Benefits in the NDAA include the allocation of 275 acres of land managed by the Bureau of Land Management to Elko County, Nev., for a motocross park and the promise of new opportunities for off-highwayvehicle recreation on public lands. Also, more than 10,000 acres of land near the city of Las Vegas – commonly referred to the Nellis Sand Dunes – received the status of Off-Highway Vehicle Recreation Area, with an additional 960 acres being conveyed to Clark County, Nev., for the Clark County Off-Highway Vehicle Recreation Area. This land is only permitted “to provide a suitable location for the establishment of a centralized off-road vehicle recreation park in the County.” Additionally, language from S. 841 and H.R. 1839, the Hermosa Creek Watershed Protection Act, was included. The language guarantees OHV access in the Hermosa Creek area, a prospect that had been threatened by a recently released USFS Resource Management Plan. Aside from the additional riding areas and protections in the NDAA, the bill also designates about 245,000 acres of new federal Wilderness that could result in the closing of some off-highway-vehicle trails. Meanwhile, H.R. 83 (CRomnibus), the $1.1 trillion bipartisan deal to fund the majority of the government through the fiscal year, includes a provision that prohibits the Secretary of the Interior from writing or issuing protections under the Endangered Species Act of 1973 regarding the greater sage-grouse, the Columbia River basin distinct population segment of greater sage grouse, the bi-state distinct population segment of greater sage grouse, or the Gunnison sage grouse. It is expected that delaying the listing of the sage grouse under the Endangered Species Act will allow more time for state and local entities to coordinate and implement local solutions. State News Sacramento, Calif.: AB 51, introduced by State Assemblyman Bill Quirk, would authorize a motorcycle to be driven between rows of stopped or moving vehicles in the same lane if the speed of traffic is 35 miles per hour or less and the motorcycle is driven no more than 10 miles per hour faster than the speed of traffic. The “lane-splitting” bill would provide that these provisions do not authorize a motorcycle to be driven in contravention of other laws relating to the safe operation of a vehicle. Helena, Mont.: House Bill 78 would protect the privacy of all drivers — including motorcyclists — by codifying provisions stating that 18 February 2015 A.B.A.T.E. OF GEORGIA, INC. NEWSLETTER only owners, leases and authorized representatives can gain access to recorded data in the event of a crash. The legislation would cover all recording devices, including cell phones, event data recorders (“black boxes”), geographic information systems and all other devices that collect, store or transmit recorded data. If passed, this would become one of the nation’s strongest driver-privacy acts. Police with proper authorization could collect any of the aforementioned information. Austin, Texas: A bill would institute a new vehicle miles traveled tax on motorists across the Lone Star state. TX H 151 would levy a one-cent tax per mile a vehicle travels. Miles traveled would be determined by visiting an authorized station for an odometer reading. Industry News Sacramento, Calif.: Total Control Training Inc. has been awarded the contract for the California Motorcyclist Safety Program. Established in 1994, the CMSP is the state’s official motorcycle safety training program and is administered by the California Highway Patrol. Instruction by TCTI begins Jan. 1. CMSP programs cater to new riders of all ages, with courses that combine classroom instruction and practical riding exercises. Motorcycles and helmets are provided free of charge. Upon successful completion of the course, students receive a certificate that waives the state’s riding-skills test requirement. CMSP expects to train 65,000 motorcyclists a year and operates more than 120 training sites throughout California. NCOM BIKER NEWSBYTES Compiled & Edited by Bill Bish, National Coalition of Motorcyclists (NCOM) MINNESOTA ANTI-PROFILING MEASURE INTRODUCED A proposed anti-profiling bill before the Minnesota House would create rules to reduce perceived profiling of motorcycle riders and would require several law enforcement groups to draft anti-profiling practices when dealing with the riders. Once drafted, law enforcement agencies would then have to train every officer and verify that with the state. House File 59, “Motorcycle Profiling,” was filed on January 12, 2015 in the state House of Representatives and referred to the Public Safety and Crime Prevention Policy and Finance Committee, and the bill stems from claims that police have been pulling over motorcyclists without reasonable cause: “Purpose. The legislature finds that the reality or public perception of motorcycle profiling alienates people from police, hinders community policing efforts, and causes law enforcement to lose credibility and trust among the people law enforcement is sworn to protect and serve. No stop initiated by a peace officer should be made without a legitimate reason; the fact that someone rides a motorcycle or wears motorcycle paraphernalia is not a legitimate reason. Law enforcement policies and training programs must emphasize the need to respect the balance between the rights of all persons to be free from unreasonable governmental intrusions and law enforcement's need to enforce the law.” The measure defines “motorcycle profiling” as “(T)he illegal use of the fact that a person rides a motorcycle or wears motorcyclerelated accouterments as a factor in deciding to stop and question, take enforcement action, arrest, or search a person or vehicle with or without a legal basis under the United States Constitution or Minnesota Constitution.” HF 59 is co-sponsored by Rep. John Petersburg (R-Waseca) who said that he signed on to the bill in part because he heard claims of profiling on the campaign trail. In October, he attended a forum hosted by American Bikers for Awareness, Training and Education, or ABATE. “Because they’re riding motorcycles and wearing motorcycle gear, they’re getting stopped,” Petersburg said. A representative for ABATE of Minnesota told the Owatonna People’s Press that an anti-profiling bill was among the group’s top legislative priorities. Minnesota was the first and only state in the country to enact a biker anti-discrimination law; Minnesota Statute Section 604.12, enacted in 1998 states in part: “A place of public accommodation may not restrict access, admission, or usage to a person solely because the person operates a motorcycle or is wearing clothing that displays the name of an organization or association.” S.C. BILL AIMS TO REQUIRE CHILD SAFETY SEATS AND BELTS ON MOTORCYCLES A bill that would require babies and small children to be secured to a motorcycle with seat belts is under consideration by South Carolina lawmakers. S.C. state Rep. Joseph Daning (R-Berkely Co.) filed legislation (H. 3040) that would require a standard, rear-facing child safety seat to be used for motorcycle passengers from birth up to 1 year of age, and for a belt-positioning booster seat with both lap and shoulder belts for children younger than 7 and weighing 40-80 pounds. 19 February 2015 A.B.A.T.E. NEWSLETTER “We take care of our children in cars, but they’re so unprotected on the back of motorcycles” said Daning, who added that the bill was prompted by constituents who feared an ex-spouse would ride their children on a motorcycle. Rep. Bill Taylor called Daning’s proposal “government overreach” and said motorcyclists are a safety-conscious community, but child-safety advocates support Daning’s efforts. Only a handful of states impose a minimum age for riders, and South Carolina is not one of them according to the Children’s Trust of South Carolina, pointing out that 25 children required emergency medical attention due to motorcycle injuries in the state from 2007 through 2009. ABATE of SC state coordinator, Ralph Bell, emphasized that there have been no fatalities of passengers under 7, and said changing the law would hinder charity events. Dennis Welborn, the state legislative coordinator for ABATE told the Morris News Service that “Its passage would cause much more harm than good," and in particular, mounting a child safety seat on a motorcycle would change its center of gravity, making it unwieldy, affecting its handling and braking abilities. MSF CONTRACTED TO MANAGE INDIANA MOTORCYCLIST SAFETY PROGRAM The Motorcycle Safety Foundation has been awarded a four-year contract by the Indiana Bureau of Motor Vehicles to provide motorcycle training, beginning March 1, 2015. The contract award marks the end of the state’s training relationship with ABATE of Indiana, which had been training riders since the 1970s. According to Jay Jackson, ABATE executive director, more than 125,000 students completed its courses during that time. The ABATE board of directors voted not to renew its contract. The MSF will oversee Indiana’s statewide training locations, provide an Indiana-dedicated website and online class enrollment function and administer all aspects of training, including MSF’s extensive quality control program. Indiana law requires would-be motorcycle riders to first obtain a learner’s permit, and then pass a motorcycle skills test or present a certificate of completion from a BMV-approved motorcycle safety course. After March 1, Hoosiers who pass the MSF Basic RiderCourse will not need to take Indiana’s on-cycle skills exam. “We’d like to recognize ABATE of Indiana for their achievements in providing motorcycle training over the past several years through the state’s network of training sites and trainers,” said MSF Vice President Robert Gladden. More than 7.5 million riders internationally have completed motorcycle training using MSF’s curricula in the foundation’s 40-plus year history. VEHICLE DATA PRIVACY CONCERNS VOICED IN MONTANA A Montana House panel recently heard a bill to give vehicle owners more control over the large stores of information now accumulated by newer cars and trucks, and motorcycles. House Bill 78, sponsored by Rep. Ryan Lynch (D-Butte), would give vehicle owners more control of that data by codifying provisions stating that only owners, lessees and authorized representatives can gain access to recorded data in the event of a crash. Insurance companies already make use of telemetrics -- the many pieces of data that reflect driving habits -- but insurance lobbyists say they're willing to sit down with supporters and hammer out a bill that's agreeable to everyone. This is just one of several privacy bills the Montana Legislature will consider this session and, if enacted, the law would become the nation’s strongest driver-privacy act. GLOBAL MOTORCYCLE MARKET PROJECTED TO EXPAND The worldwide demand for motorcycles is forecasted to grow by 6% annually to over 132 million units by 2018, valued at $120 billion, according to a 502-page study released this past December by Freedonia Market Research. Four major trends will drive growth through 2018: 1- An increasing number of households in industrializing countries will be able to afford motorcycles as personal incomes rise. 2- Sales of electric bicycles (e-bikes) and other electric models are projected to rise sharply outside of China from what are currently very modest levels of demand. 3- Motorcycle sales in a number of countries will be spurred by government programs aimed at reducing environmental pollution caused by automobiles. 4- Market advances will accelerate in a number of important markets such as Brazil, Indonesia, Thailand, the U.S., and Vietnam. However, further gains will be restrained by slowing growth in China, the world’s leading market for motorcycles, because of the large number of motorcycles already in use there. Market gains will also be dampened due to substitution by consumers of light vehicles for motorcycles in China and other industrializing countries. MOTORCYCLE INJURIES & FATALITIES ON DECLINE The National Highway Traffic Safety Administration (NHTSA) has announced that motorcycle fatalities have dropped for the second year in a row, representing the largest drop in fatalities for any road user. According to the Fatality Analysis Reporting System, motorcycle fatalities for 2013 dropped from 4,986 to 4,668; and the 6.4% decrease was the largest percentage drop of all vehicle 20 February 2015 A.B.A.T.E. OF GEORGIA, INC. NEWSLETTER categories. Fatal motorcycle crashes involving alcohol dropped by 117 deaths, or 8.3%, also the largest decrease in the category. NHTSA also reported a drop in the number of injured motorcyclists from 93,000 to 88,000, a 5.4% drop, again the largest decrease in the category. Motor vehicle fatalities overall decreased by 3.1% from 2012-2013 and injuries declined 2.1%. FEDERAL LEGISLATION REINTRODUCED TO CURB MOTORCYCLE-ONLY CHECKPOINTS Motorcycle-only checkpoints would be discouraged under a bipartisan bill reintroduced January 8, 2015 by a group of senators in the new 114th Congress. The bill would prohibit the National Highway Traffic Safety Administration from issuing grants to states to fund motorcycle-only checkpoints. Sponsoring senators say such roadblocks are discriminatory, where riders are specifically targeted by police to check that their vehicles meet state standards for noise, handlebar height, tire condition and other requirements, including helmet compliance. The states of California, Louisiana, Missouri, North Carolina, Illinois, New Hampshire and Virginia have all passed legislation to prohibit motorcycle-only checkpoints. CONGRESSIONAL BILL CALLS FOR ETHANOL STUDY Once again, on January 6, 2015, U.S. Rep. James Sensenbrenner (R-WI) reintroduced a bill in the new Congress calling for further study of ethanol and its effect on internal combustion engines. H.R. 21 would repeal the U.S. Environmental Protection Agency’s waiver decision related to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent scientific analysis of the effects of gasoline containing up to 15% ethanol. Sensenbrenner said, “Our constituents use boats, motorcycles, snowmobiles, cars, lawnmowers and tractors. They deserve to definitively know what E15 will do to the engines they rely upon.” No motorcycles or ATVs are currently on the approved EPA list for E15 use, and the use of E15 can void manufacturers’ warranties. WEIRD NEWS: YOUTUBE VIDEO LEADS TO STUNT RIDER ARREST A cop couldn’t corral dozens of reckless riders who took over a California highway, performing dangerous stunts and taunting the officer, but the marauders left an obvious trail on social media. One stunter, armed with cameras mounted on the front of his motorcycle and helmet, filmed what turned out to be incriminating evidence that later led to his arrest. The video, posted to YouTube and garnering over 1.5 million views, shows several brazen bikers popping high speed wheelies and buzzing a California Highway Patrolman, who is also on a motorcycle and attempting to pull over one or more riders before giving up due to safety concerns. As the officer backs off, bikers are seen exuberantly pumping their fists in the air in a short-lived victory celebration. Three weeks later, following an internet trail including personal information posted in social forums, police busted the 32-year old stunt rider who recorded -- and shared -- video of the wild ride and arrested him at his house in Brentwood on felony accessory and obstruction charges, as well as a marijuana grow operation in his home. Jeanne Shaheen (D-N.H.), Ron Johnson (R-Wis.), Kelly Ayotte (R-N.H.), Joe Manchin (D- W.Va.) and Susan Collins (R-Maine) would prohibit the use of federal funds in establishing motorcycle-only checkpoints. Specifically, the “Stop Motorcycle Checkpoint Funding Act” would restrict the Secretary of Transportation from granting funds to any government entity for a program to check helmet use or to create checkpoints for an operator of a motorcycle or a passenger on a motorcycle. The American Motorcyclist Association and the Motorcycle Riders Foundation fully support the bill. “Motorcycle-only checkpoints are discriminatory, forcing riders and their passengers to do something not asked of other citizens, simply because we choose to travel on two wheels, or three, instead of four,” said Wayne Allard, AMA vice president for government relations. “The AMA believes the money used for these operations could be better spent supporting programs that conduct rider education, reduce distracted driving and encourage motorist awareness of motorcycles.” “We are excited to work on this most important issue,” said Jeff Hennie, vice president of government relations and public affairs for the Motorcycle Riders Foundation. “It is imperative that we end the discriminatory act of motorcycle only checkpoints.” Motorcycle riders already are subject to state registration, inspection, licensing and helmet laws and must stop at sobriety check points like all other motorists. The MRF and AMA have fought motorcycle-only checkpoints since the state of New York announced plans to set up 15 of them in 2008 to stop riders on their way summer motorcycling events. “Evidence suggests that motorcycle-only checkpoints do not effectively reduce motorcycle injuries or fatalities and do not address the factors that are the main contributors to motorcycle accidents,” the senators wrote in a press release about the bill. “Accordingly, NHTSA does not list the practice in its own 2013 Highway Safety Countermeasure Guide for State Highway Offices, which details policies and activities that the agency considers effective at reducing crash injuries and fatalities.” States use funding from the National Highway Traffic Safety Administration to pay for the checkpoints, so federal legislation can halt the practice. If passed, this federal bill will cut off NHTSA funding and ensure that riders across the country are safeguarded from these ineffective and discriminatory stops. “Using motorcyclists tax dollars to discriminate and harass them with mandatory roadside checkpoints in the name of safety is offensive and just plain wrong. No one is more aware of the condition of the motorcycle than the person riding it,” Hennie said. “If the NHTSA truly is interested in motorcyclists’ safety, it would fund proven programs that help prevent crashes, rather than these checkpoints,” Allard said. Our meeting was held on January 6 at Logan’s Roadhouse in Dalton. We had 19 members and 2 guests in attendance. We are appreciative of all who ventured out in the cold! Many folks are sick or recovering from being sick. Me, I’m working hard at not getting sick!!! We opened the meeting, as always, with the Pledge of Allegiance to our flag and a prayer, led by Dennis. December was a flurry of activity, with celebrations, toy runs, dinners, parties, etc. We spent an evening with the Cherokee Estates kids and it was wonderful, as usual. I extend a big THANK YOU to all who participated and helped make these kids Christmas a wee bit brighter. I have much appreciation to Mr. & Mrs. Santa for stopping by, as well as the lovely choir who entertained us. Some of our D1 family gathered at Donna Smith’s home for our annual Christmas dinner. As always, it was lovely and lively. The dirty Santa gift exchange always brings some laughs! Thank you, again, Donna, for hosting. She be the hostess with the mostess! The New Year is here and with it comes a new Legislative session. D1 will do what it can to support the state in their efforts to push forward on this year’s agenda. Like most, we are “short staffed” and are without a Legislative Director for our district. Dennis Warren and I attempt to keep our folks informed, but it is difficult for us to do all that is needed. We desperately need someone to step up for this position. It is, after all, what we are here for. Our primary goal is to monitor legislation, but to also lobby for increased safety measures for all riders. We are in need of someone to communicate with our state Legislative Director and to keep our district informed. On February 14, we will host the 24th Annual Chili Cook Off with our “house” band, Double Shot playing for us. It will be held at the Chatsworth American Legion, Post 167. On April 11th, we will host the 24th Annual Poker Run. We hope to have a good turnout for both of these events. This week we are paying for having good riding weather most of the time, as I'm sure most of you are too. On 1-1-15 , we had our annual Frozen Nose to Toes Ride. Nine people and six bikes. I want to thank those that showed up in 2830 degree weather. Marvin, Terry, Dennis, David, Jim, Winston, Sheila, and Linda. Marvin showed up for breakfast and moral support. He is getting over hernia surgery, so he's still sore. Good ride without any mishaps. One of our members sent Linda and me her impression of the ride and I'm going to do my best to copy it for you to read. HERE GOES... Frozen Nose To The Toes [and everything inbetween] A group of 7 bikers and two riders met at Hardee's, in Lafayette, Georgia on the first morning of the new year. A total of six bikes headed out, without fellow biker Marvin, showing his support and sending us off. With Frank and Linda Chaney leading the way, we began the Frozen Nose to the Toes Ride. We left Hardee's about eleven am onto Hwy 27, taking a right. We rode to the fifth traffic light and turned onto 193. We took 193 to 136 west to the top of the mountain, and then turned left on 157, going south. At the end, we turned east onto 148 and then onto North 337, heading back to Lafayette. The temperature was thirty two degrees when we started out. We went eighty miles with the temperature reaching a high of thirty nine on an hour and a half ride back to Hardee's. Barely into the ride, we lost two riders on Horseshoe Curve at Pigeon Mountain, due to clutch malfunction. Dennis had to turn back and his father Terry chose to see his son make it home safe. And they did. Now a group of six with four bikes, the Chaney's, David, Jim, Winston and I continued on. Lots of curves intertwine with bare trees and a rocky mountain. The rocks formed in the thick of natures mess. Nothing but her cold, tantalizing our senses and roadkill aroma. While passing above us, I spied a large white bird flying away from us after dining on roadkill buffet. One thing I noticed on this ride was that it only takes a big dog to slow down a biker. We slowed up quicker than seeing a county car parked across the road in front of your stop sign. Being law abiding bikers, we came to a complete stop and looked both ways before resuming the ride. After arriving back at Hardee's, I told Frank they need to add more frozen parts to the name of this ride. Not kidding.. In all, it was a great way to start the new year off. With an early morning ride and good coffee among friends. Just a lady rider, behind her husband and loving the thrill of the ride. Not far from home, his shield on his helmet came undone on his left side. I gave a helping hand and held it up all the way home. 2015, BRING IT ON! Happy New Year. Froze Nose to Toes Ride - Frank Chaney led a small group on the annual New Year’s Day Froze Nose to Toes Ride. Seven bikers started out with the temperature at 32. Two had to turn back due to mechanical issues. Overall, this was a great ride! ABATE of GA Legislative Day - Frank was able to attend last Wednesday’s Chili Lunch at the Capitol for our GA Legislators. Twenty ABATE members attended with 8 on bikes. Frank said they served 10 gallons of chili and ran out at the end. Everybody seemed to enjoy themselves. Hopefully, the Legislators got the message on some “Bills” we need their support on. American Motorcycle Show - Frank was able to attend this annual show in Atlanta last Saturday. He said he helped “man” the ABATE booth for several hours. They had a good crowd in attendance, so maybe this will help our membership. We had a good Officer’s Meeting last Saturday with 14 members in attendance. Some members cannot attend our monthly meeting during the week, so we are glad they could join us at the Officer’s Meeting. Frank has been visiting several local motorcycle shops to get support for ABATE. He is leaving them with some extra ABATE Newsletters and some ABATE literature. He is also telling them about our Intersection Kits that we hope to be able to give to each school instead of just each county. Frank only has 3 kits, so we will need to purchase some more. Several of the shops are considering giving ABATE more support. Remember to tell them you are an ABATE member wherever you shop. The group talked about our upcoming rides/activities. Frank produced a schedule of rides/activities for 2015 and asked everybody to review it. I will copy the first several months on this report. We are tentatively planning on riding Feb 15th if the weather permits. We need some suggestions for this ride. John Conyers reminded everybody to be thinking about some “money making” ideas (car wash, bake sale, burger flip, gun raffle, etc.) for 2015 to keep our Treasury in the black and to keep $$ in our Downed Rider Fund. We think the best thing for us is to raffle a shotgun. Frank and some others are going to check this out. We will also be having some Poker Runs. It was voted to pass on having the Secretarie's Report read as all present had read it in the Newsletter & approved it. Anthony gave a treasury report of $649.43 in our checking account & $100.00 in our cash fund account. It was unanimously voted to pay our Activities Director, Stanley Nash $39.40 from the cash fund account for the propane he purchased to cook the turkey on the grill for the Christmas party. Many side dishes were also provided by Stanley & others. Our Legislative Director, Richard Malcolm reported that he had a reply from a letter which he sent to the Solicitor of Cobb County. Richard also stated that he had sent a letter to Gov. Nathan Deal, regarding Motorcycle Accidents & discrimination. Which he got no response to. We had a very informative speaker, Lyle Anderson to join us for the meeting & Christmas celebration. Lyle is one of the founders of the Motorcycle Safety Foundation. Founded in the late 60's & early 70's. Lyle was instrumental in the motorcycle training program & trained over 2500 students. This program has evolved over the years through 48 states. Lyle stated that the Foundation & our Government have worked very closely to make it what it is today. Anthony remarked that we need to get our membership numbers up. Anthony asked if anyone was interested in riding on New Years Day. Stop by the Capital to support ABATE and take the time to meet with your legislator to discuss issues that involve Georgia motorcyclists. A chili lunch will be available. The Great American Motorcycle Show (GAMS) will once again descend on Norcross GA and the North Atlanta Trade Center. ABATE of Georgia will be hosting a booth at the show and is looking for volunteers to man the booth. Please contact the state office if you’re able to volunteer. Secretary- ABATE District 4 East District Four West Meeting was called to order. Jc and Ann both being absent officers. Ann was on call for e-board meeting. Discussed Lobby Day at the Capitol. New space open at the capital to assemble, parking will be tricky. Less visibility to legislatures with the new “Liberty Plaza.” No more “Front Door” gatherings at the capitol. There is a group of ABATE members going down to scout out the parking conditions ahead of time. Parking could be at member’s expense. The state had chosen Confetti’s to provide the Chili Lunch on the Georgia Capitol Rotunda. The hope is a tasty meal will provide the house with an open mind in the upcoming assemblage of bills on Motorcycle Rider Needs to the ABATE voice. Word is there will be new state t-shirts available at this time. The District 4 West Toy Run was a success. There was a nice turn out on a beautiful day. It was wonderful to see the faces, both old and new. Youth Services, the Youth themselves, and the Foster families expressed their gratitude. It is a beautiful thing to see the harmony and love that were expressed. It would be wonderful to see this every day of the year. BOD meeting is February 7th @ AP’s. Jon will be travelling so a proxy will be representing District 4 West. Jon called for volunteers again, for the upcoming Great American Bike Show. Some officers stepped up with available times to help man the ABATE of Georgia table at the event. The location for the April 4th and 5th Swap Meet and Rally has been confirmed. We do not know who donated what at this time, but Thank You. Cheef reported that NHTA is reporting that road fatality numbers dropped in 2014. Sadly, 24% of these deaths are reported from Motorcycle crashes. On Jan. 1st... there were two rides planed: one was the CMA Cycle Disciples New Years Day Ride and the other was the ALR post 163 Chilly Willy Ride .... (we had District Members in each). Well somewhere along the way those on the Chilly Willy ride decided it would be a good thing to hook up with the CMA ride. They all joined up together for a nice but cool ride and fellowship and went down to Covington and for some good food at Thomas's Buffet. On Jan. 3rd... our planned 4th Annual Frosty Balls Ride from Cycle World of Athens to Top Dawg Tavern in Winder. But with the rain and freezing temperatures we decided to postpone the ride till the 10th of Jan... On Jan. 10th... 4th Annual Frosty Balls Ride... we met at 10am for sign up and 32 degrees but sunny weather. After a brief safety spiel by Allen and a ride prayer by Kurt we left at 11am for our 40 mile run. There was a total of 45 bikes and 55 folks on those bikes. We were then greeted by 32 other folks at Top Dawg Tavern that couldn't make the ride but came out to support us. The band Tangents (Troy and Roger) were there to play a little music for us. Thanks Brothers, we can always depend on you! The high finally got to 43 degrees and the sun came out and warmed it up really nice. We would like say THANK YOU!! to Brett Summers (owner of Top Dawg Tavern) and his Staff having us and for taking such good care of us. Brett is a huge supporter of District 5 North. At the end of our event he came over and said thank you along with how he is always glad to have us! We would like to THANK EVERYONE that came out to show their love and support! The Great American Motorcycle Show is being held on January 23rd - 25th at the North Atlanta Trade Center in Gwinnett County. They have allowed us to rent this room once a month for $25. Since we have many veterans that are also ABATE they have agreed to waive the $25. Voted and passed that we will keep the meetings at the VFW Post 660. They will also be able to obtain a special events license to use the facility/bar for runs etc. The cost of the license is $400.00. We have 30 shirts left from the Toy Run. We will split them with the Wingmen and have them for sale at the next meeting. They are $20. The Toy Run made $2500 and tons of toys for the kids, I believe we bought 3,000 kids toys. The Christmas Party was fun and the Photo Bombs were hilarious! It was a fun party. We have Frosty Balls and the Spring Swap meet coming up soon. Springfield has agreed to not force security on us and has raised the band curfew to 11:00. Jim Simmons (fairground staff), Bobby Tebeau and I, went to the City Council meeting and Jim told them that it is like a big family with kids and adults and there have been no issues so they will allow us to maintain our own security. This will save us about $1,000. They also agreed to let the band play until 11:00 PM. Last year we paid $1400 for bands this year it will be about $1200 with High Velocity playing Friday and Saturday night and another band playing Saturday afternoon. The bands for the Southern State Swap meet here on June 13th and 14th are lined up for Saturday and Sunday. The State meets are a little different in that they don’t have bands and events on Friday but they do have them on Sunday until around 7:00 PM. New Business: This year will be the 25th Anniversary of many of our events. We are thinking of getting some 25th Anniversary D11 tee shirts. Voted – Grey short sleeve shirts with pocket and navy blue print. They will have logo on the front and back stating 25 years. We talked about ordering 40 shirts and did a sign up sheet for the members at the meeting to commit to shirts and sizes. We had 38 shirts requested and decided to order a total of 100 shirts. I am very proud of our district. All of our events have made a profit, our membership is up, attendance at the meetings is up, we have many volunteers that are willing to help. Gale, VFW Post 660: We are having a Fish fry on 1/23/15 and a Sweetheart dance in Feb. Our Homeless Vet Project takes place on Tuesdays at 1:00 PM. We help set up homeless in campsites. We need food, blankets, camping gear etc. We also need female products. We visit them on Saturday and try to provide them what they need. They never ask for much, just the bare minimum. If you can help with some items or come and help us set up the site we would appreciate it. We are also looking for WWII, Korean, or terminally ill veterans for the Honor Flight in May. There are not many left and we want to make sure they get the opportunity to go. St. Louis: Carrie and David with Hoofs for healing are having an event at Los Bravos on 2/2/15. A portion of the proceeds made that day will be donated to Hoofs for Healings. Please come out for some good food and drinks for a good cause. Free Entry pass won by Coach, 50/50 $40 won by Coach and donated back to Jr. Abate Meeting adjourned at 4:20PM Next Meetings: February 8, 2015, March 8, 2015 Polaris Slingshot Now Rejected by Two States By Chuck Watwood Lawbike.com Connecticut is the latest state to reject the Polaris Slingshot. Polaris received notice from the Connecticut Department of Motor Vehicles in early December stating that the Slingshot more closely resembles an automobile, a designation that would require it to meet more stringent safety standards. "It is the consensus of the DMV that this vehicle closely resembles an automobile in appearance, and is equipped (brake, clutch, accelerator, steering wheel, four-cylinder engine, seat belt, gear shifter, etc.) and handles like an automobile rather than a motorcycle," wrote DMV senior attorney Sharon Geanuracos. The DMV has suggested Polaris go to the state Legislature to create a new classification for the vehicle. This comes on the heels of rejection from the State of Texas. In November, Polaris Dealers in the State of Texas were notified that they would be unable to sell the new Slingshot because customers will not be allowed to register their new Slingshot as a street legal motorcycle. According to the Texas DMV, the Polaris Slingshot is not classified as a motorcycle. While the company is working with the DMV to find a resolution, no timeline was given. The conflict centers on the definition of a motorcycle in Texas. The Texas Department of Public Safety Motorcycle Operator’s Manual defines three-wheelers by certain characteristics, such as “saddle seating,” which means “seating in which the rider/passenger straddles the vehicle” or “If designed for a passenger, the passenger must be seated behind the operator (or in a separate passenger compartment in the case of a motorcycle with sidecar).” The manual diagram includes examples of both a traditional trike with one front, two back tires, as well as a two front, single back tire like a Can-Am Spyder. While the Slingshot has a two front, one back design, the seats are side-by-side, with three-point seatbelts. That's why Texas will not classify it as a motorcycle. The company states that "Virtually all states classify Slingshot as a motorcycle, and therefore any licensing regulations and restrictions (like helmet laws) that apply to motorcycles also apply to Slingshot. California is an exception in that it classifies Slingshot as a 3-wheeled motorcycle, which can be ridden with only a Class C license. Virginia classifies it as a 3-wheeled motorcycle and offers a special 3-wheeled motorcycle license (M3).” The company originally had approval from the State of Texas to sell Slingshots until learning of the reversal on November 4. The matter is complicated further by the fact that similar vehicles with the same seating arrangement, such as the Morgan Three-Wheeler and Campagna T-Rex, are capable of being registered in the state. In addition to being a pressing issue to Polaris, the decisions made in Texas and Connecticut could have far-reaching effects. The precedence these states set has the potential to sway the definition of motorcycles and three-wheel vehicles in more states, as well. OF GEORGIA, INC. NEWSLETTER State Legislative Report On Monday, January 12 the 2014 Legislative Session was gaveled open in the Georgia General Assembly. Most of week one is taken up by ceremonial events and organization. However, ABATE got off to a great start and, I believe most of the Legislators already know we are here with a new attitude and agenda. I started out Monday with meetings with Sen Bill Jackson(R, Appling) and Rep. Ben Harbin(R,Evans) to go over the wording of the “Motorcycle Mobility Safety Act” and the “Handlebar Height Repeal”. In meetings a few months ago with myself and Brad Coulston, they had agreed to sponsor these Bills. Sen. Jackson agreed to sponsor the MMSA ( Redlight) in the Senate and asked that I meet with AAA and the Governors Office of Highway Safety to identify any concerns they had. I met with the representatives of AAA and Mr. Harris Blackwood and went over both of these proposed bills in detail. They indicated no opposition to these bills. I also discussed with Mr. Blackwood and Sen. Jack Hill( R, Reidsville, Chrm of Appropriations) the idea of restoring funding for the GMSP by the tag fees are still paying. It was a very positive conversation and both asked for more information and a follow up meeting. Mr. Blackwood expressed to me his desire for anything that would improve safety. I assured him that the safety of all bikers was very important to ABATE. We also had a lengthy discussion on our position of “Freedom of Choice” with helmets and I challenged him that we could show him manipulation of the data on accidents and helmets if he would allow us the dialog with him. On Tuesday I met again with Rep. Harbin and Rep. John Yates (R, Griffin) about the bill to repeal the 15” Handlebar height law. Rep. Yates had responded positively to the “agenda Letter” sent out by Brad to many Legislators. It was decided that Rep. Yates would be the primary sponsor and Rep. Harbin would be the 2nd signer. Tuesday afternoon both this bill and the MMSA bill was sent to Legislative council to be printed and readied for introducing. The language on both bills is exactly as the bills were in our “agenda”. The rules require the Bills to be read in their prospective bodies 3 times and then assigned to committee. Next week is Budget hearings so the House and Senate will not reconvene until the 26th. We should have Bill #s and Committee by the 29th. I met with many Legislators this week. To many, it was simply renewing old acquaintance, letting them know I was representing ABATE and to those who were elected in the last few years it was a matter of introducing myself. I discussed our agenda items with all, particularly focusing on the 2 Bills we have sponsors for. Some asked questions but most expressed support and a willingness to help. On Thursday I was fortunate to run into Speaker Ralston and had the opportunity to personally thank him for allowing us to meet with Terry Chastain and ask for his help with our Bills. He was very positive and asked that I come and see him as soon as they reconvened. These are the Legislators I met with this week.
