GEISSMAN TIMOTHY C. SMITH Mrs. Geissman offered the following resolution and moved the adoption of same, which was duly seconded by Mr. Smith. RESOLUTION NO. 15-0065 RESOLUTION FOR THE PROJECT KNOWN AS MED-CRPM-FY2020 TO INSTALL NEW PAVEMENT MARKINGS ON VARIOUS MEDINA COUNTY ROADS, THEREBY IMPROVING SAFETY FOR MOTORISTS WHEREAS, Section 5555.06 of the Ohio Revised Code provides that the Board of County Commissioners of Medina County may by resolution adopted by a unanimous vote find that the public convenience and welfare requires the project known as MED-CRPM-FY2020 to install new pavement markings on various Medina County roads in Medina County (hereinafter called the PROJECT); and WHEREAS; Section 5501.03 (C) of the Ohio Revised Code provides that the Director of the Ohio Department of Transportation (ODOT) may coordinate the activities of the Department with other appropriate public authorities and enter into contracts with such authorities as necessary to carry out its duties, powers and functions; and WHEREAS; the PROJECT is a transportation activity eligible to receive federal funding; and WHEREAS, the County Engineers Association of Ohio (CEAO) has provided a maximum of $100,000.00 of federal HSIP funds for the PROJECT; and, WHEREAS; it is the mutual desire of both ODOT and the Medina County Engineer to have the Medina County Engineer serve as the responsible lead agency for the administration of the project. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County that the public convenience and welfare requires the PROJECT. BE IT FURTHER RESOLVED that the Medina County Engineer is hereby authorized to make application to the Northeast Ohio Areawide Coordinating Agency (NOACA) to ensure that the PROJECT is included in the NOACA Transportation Improvement Program and to abide by all NOACA policies applicable to the PROJECT. BE IT FURTHER RESOLVED that the Medina County Engineer may enter into an agreement with the Ohio Department of Transportation to administer the PROJECT locally under the LPA policy as adopted by the Ohio Department of Transportation. BE IT FURTHER RESOLVED that the Medina County Engineer is hereby directed to complete necessary surveys, plans, profiles, cross sections, estimates of cost and specifications as are required for the PROJECT and to transmit copies of the same to this Board at the time such plans are completed. BE IT FURTHER RESOLVED that real estate will not be assessed to cover any of the costs of the PROJECT. All costs to prepare construction plans and specifications and engineering reports for the PROJECT shall be paid from Medina County road improvement funding sources. 2. The estimated total PROJECT construction and construction administration cost (2020 construction) is $100,000.00 3. Construction and construction administration costs for the PROJECT shall be paid from federal sources in the amount determined by CEAO (100% up to the PROJECT maximum of $100,000.00). 4. Construction and construction administration costs exceeding $100,000.00 shall be paid from Medina County road improvement funding sources. RESOLUTION NO. 15-0073 RESOLUTION ENTERING INTO AN AGREEMENT WITH CT CONSULTANTS WHEREAS, the Board of County Commissioners of Medina County, Ohio, is seeking a Comprehensive Housing Improvement Program (CHIP) Grant from the Ohio Department of Development, Office of Housing and Community Partnership, and WHEREAS, the Board of County Commissioners of Medina County requested qualifications and proposals from consultants to assist the County in preparing the application and administering the CHIP grant if awarded to the County, and WHEREAS, CT Consultants submitted a proposal to provide professional services required for the preparation of the grant application and administration of the grant for Medina County, and WHEREAS, the proposal submitted by CT Consultants meets all the requirements as outlined in the request for proposal and is considered the lowest and best bid. RESOLUTION NO. 15-0074 RESOLUTION ENTERING INTO A SUBRECIPIENT AGREEMENT WITH MEDINA COUNTY TRANSIT TO PROVIDE FINANCIAL ASSISTANCE FOR TRANSPORTATION SERVICES WHEREAS, Medina County Transit provides transportation service to county residents, and WHEREAS, pursuant to Title I of the Housing and Community Development Acts of 1974 and 1977, as amended, the County applied for and received a Community Development Block Grant for certain community development activities and a public service activity, and WHEREAS, included in the Medina County CDBG formula allocation is a public service activity to provide fare subsidy for Medina County residents who are in need of transportation service but lack the funds necessary for said service, and WHEREAS, a subrecipient agreement has been prepared for Medina County Transit which is attached hereto and marked as “Exhibit A”, and WHEREAS, said agreement shall be effective commencing September 1, 2014 through February 29, 2016. NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners of Medina County Ohio and Medina County Transit do hereby enter into a subrecipient agreement as required by the Ohio Department of Development for participation in the Medina County CDBG program. Voting AYE thereon: Mr. Friedrick, Mrs. Geissman, and Mr. Smith Adopted: February 3, 2015 Prepared by: Finance Department COMMISSIONERS JOURNAL VOLUME 175, PAGE 795 Community Development Block Grant Program Intergovernmental Agreement Between The County of Medina And Medina County Public Transit THIS AGREEMENT, entered into as of this 3 day of February, 2015 by and between the BOARD OF MEDINA COUNTY COMMISSIONERS (hereinafter referred to as the “County”) and the MEDINA COUNTY PUBLIC TRANSIT (hereinafter referred to as the “Recipient”), located in Medina, Ohio, WITNESSETH: WHEREAS, pursuant to Title 1 of the Housing and Community Development Acts of 1974 and 1977, as amended, the County has applied for and received a Community Development Block Grant (CDBG) for certain community development activities; and, WHEREAS, included in said application or provided for in subsequent amendments to said application, is the activity entitled: Public Service – County of Medina; and, WHEREAS, the County has determined the Recipient possess the staff and capacity to undertake the transportation services activity for Low/Moderate Income individuals residing in the County of Medina; and, WHEREAS, it is necessary that the County and the Recipient enter into an Agreement for the implementation and undertaking of said activity. NOW THEREFORE, the parties hereto do mutually agree as follows: I. GENERAL The County wishes to ensure residents needing transportation services who live in the County, (excluding the Cities of Brunswick, Medina, and Wadsworth) will not be denied transportation service if they are unable to pay the fare. The Board of County Commissioners have determined that up to $26,400 of the 2014 Medina County Community Development Block Grant Program (CDBG), respectively, is to be allocated for the purpose of providing fare subsidy to assist county residents who need transportation service but are unable to pay for said service. The service provided by the Recipient is consistent with the County’s CDBG Program, and is eligible to receive funding from the annual CDBG formula allocation as a public service activity. II. SCOPE OF SERVICES The Recipient hereby agrees to utilize funds made available under the CDBG program for the following purpose: A. The Recipient hereby agrees to utilize funds made available under the CDBG program for transportation services for Low/Moderate income persons and/or elderly and disabled residents of Medina County who reside outside the Cities of Medina, Brunswick and Wadsworth. B. The Recipient shall provide and maintain independent books, records, payroll, documents, accounting procedures and practices which sufficiently and properly reflect all costs expended in the performance of his Agreement. Such records shall be subject at all reasonable times for inspection, review, or audit, by duly authorized County, State, and Federal personnel. COMMISSIONERS JOURNAL VOLUME 175, PAGE 796 The Recipient shall maintain and preserve all financial records related to this Agreement, including any other documentation used in the administration of the program in it’s possession for a period of three (3) years, and/or will assure the maintenance of such for a like period of time in the possession of any third party performing work related to this Agreement, unless otherwise directed by the County. III COMPENSATION The County agrees to pay the Recipient up to $26,400 of the 2014 CDBG Block Grant, respectively. Payment shall be subject to receipt by the County of a requisition from the Recipient. Payment to the Recipient shall be made no sooner than receipt of funds by the County from the State of Ohio. IV. TIME This Agreement shall take effect September 1, 2014 and continue through February 29, 2016. V. FEDERAL COMPLIANCE REPORTS AND RECORDS The Recipient must maintain records of service provided, as described herein and shall also comply with all applicable provisions, rules, guidelines, and regulations in accordance with Office of Management and Budget Circular A-133, A-122, A-128, and A-87; including Attachment F of OMB Circular A-110. The County shall have the right to monitor at any time, the services provided by the Recipient whether in the field, or at the Recipient’s Offices. The Recipient shall also provide to the Department of HUD and/or the County, at its request, statistical and narrative reports or other statements, record, dates and information on the activities performed pursuant to this Agreement. The County, the Office of Assistant Secretary for Community Planning and Development, the U.S. Department of HUD, the Comptroller General of the United States, the State of Ohio Office of Housing and Community Partnership or any of their authorized representatives shall have access at any time during normal business hours to all books accounts, record, reports, files, and other papers or property of the recipients pertaining to funds provided under this Agreement for the purpose of making surveys, audits, examinations, excerpts, and transcripts. All data, information, and reports generated as a result of this Agreement are the property of the Board of Medina County Commissioners and may not be used, reproduced, or released without the Boards permission and consent. VI. INDEMNITY AND INSURANCE A. The Recipient agrees what it will at all times during the existence of this Agreement indemnify and save harmless the County or any of it’s employees and agents against any and all liability, loss, damage, and/or related expenses incurred as a result of the Recipient’s provision for services. VII. EQUAL OPPORTUNITY The Recipient agrees to comply with: A. Title VI of the Civil Act of 1964 (P.L. 88-352) and the HUD regulations under 24 CFR Part 1 that no person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity receiving Federal Financial Assistance by taking any measures necessary to effectuate this Agreement. Title VIII of the Civil Act of 1968 (P.L> 90-284), as amended by the housing and Community Development Acts of 1974 and 1977, and will administer all programs and activities relating to housing and community development in a manner to affirmatively further fair housing throughout the Unites States. C. Section 109 of the Housing and Community Development Act of 1974 and 1977. as amended, and in conformance with all requirements imposed by or pursuant to the Regulations of the Department of HUD (24CFR Part 570601) issued pursuant to that Section, and in accordance with Equal Opportunity obligations of that Section, no person in the United States shall, on the grounds of race, color, national origin, or sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity funded in whole or in part with the Community Development funds. D. Executive order 11063 on equal opportunity in housing and related facilities owned or operated by the Federal Government or provide with Federal financial assistance. E. Executive order 11246 (Equal employment Opportunity), as amended, requiring nondiscrimination and affirmative action to assure nondiscrimination in employment by Government contracts and subcontracts, and under federally assisted contractors. Prohibits discrimination against any employee, or applicant for employment on the basis of race, color, religion, sex, or national origin. Provisions to effectuate this must be included in all construction contracts exceeding $10,000. Implementing regulations at 41 CFR Part 60). F. Section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C.,1701) as amended, and the HUD regulations issued pursuant hereto (24 CGR Part 135). Section 3 requires that employment, and other economic opportunities generated by federally financed community development activities, such as contracts for construction or the provision of services, to the greatest extent feasible, be directed to serve low and very low income person who live in the jurisdiction of the grantee. G. Age Discrimination Act of 1975, as amended, (42U.S.C. 601), which prohibits age discrimination in programs receiving federal financial assistance. VIII. SUBCONTRACTORS All work or services covered by this Agreement which is subcontracted by the Recipient shall be specified in a written contract and subject to all provisions of this Agreement. All subcontractors must be approved by the County and the Department of Housing and Urban Development prior to execution. IX. INTEREST OF CERTAIN FEEDERAL OFFICIALS No member of a Delegate to the Congress of the United States, and no resident Commissioners, shall be admitted to any share or part of the Agreement or to any benefit to arise from the same. X. MEMBERS OF LOCAL GOVERNING BODY OR OTHER PUBLIC OFFICIALS No member, officer, or employee of the Political Subdivision or its designees or agents, no member of the governing body of the locality in which the program is situated and no other public official of such locality or localities who exercises any function or responsibilities with respect to the program during his tenure or for one year thereafter, shall have any interest, direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in connection with the program assisted under this Agreement. HATCH ACT The Recipient agrees to comply with all provisions to the Hatch Act and that no part of the program will involve political activities, nor shall personnel employed in the administration of the program be engaged in activities in contravention of Title V, Chapter 15 of the United States Code. XII. COMPLIANCE WITH ENVIRONMENTAL REQUIREMENTS The Recipient agrees to comply with the provisions of the National Environmental Policy Act of 1969 insofar as the provisions of such Act apply to activities set forth in the Recipient’s CDBG Application. The Recipient agrees to assume responsibility for preparing the Environmental Assessment and Environmental Impact Statement as required. XIII. TERMINATION OF AGREEMENT The County may suspend or terminate the Agreement in the event of default, inability, or failure to perform on the part of the Recipient, or when the County and the Recipient agree to terminate the Agreement in whole or in part. In the event of termination, the Recipient will transfer to the County any CDBG funds on hand at the time of termination. The County may terminate this Agreement and such additional supplemental agreements hereafter executed, in whole or in part, and may recover any Block Grans funds at its discretion if the Recipient: A. Violates and provision of this Agreement; or B. Violates any provision of the Housing and Community Development Acts of 1974 and 1977 as amended; or C. Violates any applicable regulations or terms and conditions or approval of the applications which the Secretary of HUD has issued or shall subsequently issue during the period of this Agreement; or D. Fails to complete performance in a timely manner. The County may also terminate this Agreement and such additional supplementary agreements hereafter executed, in whole or in part, by giving the Recipient thirty (30) days written notice, in the event that the Secretary of HUD shall: A. Withdraw funds allocated to the County under its application for programs or activities which substantially prevent performance of the Community Development Program in the County or the Political Subdivision; B. Terminate the County’s funding allocation pursuant to an Act of Congress; and C. Fail to approve a grant application by the County. XIV. AUDITS Recipient standards for financial management shall comply with Attachment F or OMB Circular A-128. The audit shall test the fiscal integrity of the financial transactions, as well as comply with the terms and conditions of Federal grants and other governments. The audits shall be conducted annually by the grant Recipient. The County shall be provided with a copy of the audit. If the audit would indicate audit findings: A. CDBG funds cannot be dispersed until audit findings are corrected, and B. Documentation of corrective action taken shall be provided to the County COMMISSIONERS JOURNAL VOLUME 175, PAGE 799 XV. COMPLIANCE WITH STATUTORY REQUIREMENTS This Agreement, subject to the requirements of; the Flood Disaster Protection Act (p.L.93-234); the Clean Air Act, as amended, 42 U.S.C. 1857 et. Seq.: the Archaeological and Historic Preservation Act of 1974 (P.L. 93-291), along with P.L. 89-665 and Executive Order 11593; Lead Based Paint Poisoning Preservation Act (42 U.S.C. 4831 et. Seq.); the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970; the Rehabilitation Act of 1973 and all applicable rules, regulations, and guidelines promulgated by the Secretary of the Department of Housing and Urban Development, the Office of Management and Budget, and the General Services Administration. The Recipient will comply with the Regulations of the Federal Department of Housing and Urban Development, including these listed in Attachment II Certification Regarding Lobbying. This space consists of approximately 570 square feet. The Red Cross shall also be granted permission to utilize a County‐owned parking lot, located on S. Elmwood Street, to place its trailer. This permission shall be contingent upon City of Medina zoning authorization. The usage period shall be March 1, 2015 through February 29, 2016. In consideration of the use of the space, the Red Cross shall compensate the County in the amount of $1,435. This payment shall sufficiently cover space usage and utility costs for the one year period. The Red Cross shall be responsible for any required telephone/cable installation expenses and monthly recurring costs. The Red Cross shall maintain and keep in good condition or repair the interior and exterior of the premises. Should the Red Cross, through its activities and/or use of premises, cause damage to the premises, the Red Cross would then be responsible for repair. The County shall provide snow removal and ice removal on the days the facility is in use (generally limited to Monday through Friday). The Red Cross shall also hold the Medina Board of County Commissioners, its employees and agents, harmless and indemnify the County from and against any and all claims, actions, or causes of action arising from the Red Cross’ use of the premises, except if caused by the County’s negligence or intentional acts. The County shall be listed as an additional insured on the Red Cross’ insurance policy. A copy of the Certificate of Insurance shall be provided to the County.
