NOTAS:
a) Derivado de la notificación al IEEDS de los oficios emitidos por la Agencia Nacional de Seguridad Industrial y de Protección al Medio Ambiente del Sector Hidrocarburos
(ASEA). Unidad de Asuntos Jurídicos. Dirección General de lo Consultivo, recibidos en fechas 26 de febrero y 04 de marzo de 2016, mediante los cuales señala:
“…Dentro de las reformas en Materia de Energía se estableció en el artículo 95 de la Ley de Hidrocarburos, que el Sector Hidrocarburos es de orden público
e interés social, siendo además de exclusiva jurisdicción federal, precepto que se transcribe para pronta referencia: “Articulo 95.- La Industria de
Hidrocarburos es de exclusiva jurisdicción federal. En consecuencia, únicamente el Gobierno Federal puede dictar la disposiciones, técnicas
reglamentarias y de regulación en la materia, incluyendo aquellas relacionadas con el desarrollo sustentable, el equilibrio ecológico y la
protección al ambiente en el desarrollo de esta industria””.
“…Por lo que respecta a la regulación y Autorizaciones en materia de Protección al Medio Ambiente, seguridad industrial y operativa, la propia Ley de
Hidrocarburos en su artículo 129, refiere que tales facultades corresponderán a esta Agencia, siendo que dentro de los permisos ambientales se encuentran
la evaluación del Impacto y Riesgo Ambiental….. el Sector de Hidrocarburos, es de exclusiva competencia federal, por lo que únicamente al
Gobierno Federal compete lo relativo a la regulación, autorizaciones ambientales que se requieran en las actividades del Sector Hidrocarburos”
Por lo anterior, se informa que la validación en materia de Riesgo Ambiental para Prestadores de Servicios Ambientales del IEEDS será únicamente para actividades en las
que no se requieran derivados de Hidrocarburos.
b) Favor de verificar que el Prestador de Servicios Ambientales a elegir este vigente al momento de contratar sus servicios.
