Panel de alto nivel para el simposio “Entender la autodeterminación, el
traspaso de competencias y la independencia en el siglo XXI”

El Viceministro Principal, Joseph García, ha inaugurado esta mañana en la Biblioteca Garrison el
simposio “Entender la autodeterminación, el traspaso de competencias y la independencia en el
siglo XXI”.
La organización de este evento ha corrido a cargo de Jennifer Ballantine-Perera, Directora de la
Biblioteca Garrison, en colaboración con la Oficina del Viceministro Principal.
Un panel internacional de alto nivel —formado por académicos, juristas y demás partes relevantes
para este debate— expondrá ponencias sobre el tema de la conferencia desde su propio punto de
vista.
En la jornada inaugural, Sir Graham Watson presentará el tema “El desarrollo de la idea de la
autodeterminación de los pueblos, expresada por el Presidente estadounidense Woodrow Wilson”.
A continuación, hablará Robert Woodthorpe Browne 1, miembro del Royal Institute for Foreign
Affairs Chatham House, miembro del Consejo de la Internacional Liberal y Presidente del Comité de
Relaciones Internacionales del Partido Liberal Demócrata británico. El título de su ponencia será: “La
autodeterminación, desde una perspectiva liberal internacional”. Tom Grant 2, del Centro
Lauterpacht de Investigación para el Derecho Internacional de la Universidad de Cambridge hablará
después sobre “La autodeterminación en el Derecho internacional: pasado y futuro(s)”.
En la sesión de la tarde, tendrá lugar un debate sobre el traspaso de competencias y la
independencia de manos de Joaquim Torra 3, Director de El Born Centre Cultural de Cataluña 4, quien
analizará la situación que vive esta región. A continuación, intervendrá Jon Iñarritu García, diputado
por Bizkaia en el Congreso español, que hablará sobre el traspaso de competencias y la
autodeterminación en el País Vasco desde su propia perspectiva. El próximo ponente será el
Catedrático Jesús Verdú Baeza 5, Director del Campus de Algeciras de la Facultad de Derecho de la
Universidad de Cádiz, quien aportará la perspectiva española sobre la cuestión de la
autodeterminación frente a la integridad territorial en relación con Gibraltar.
La última intervención del día correrá a cargo de Alan Boyle 6, Catedrático de Derecho Internacional
Público de la Universidad de Edimburgo, quien expondrá el traspaso de poderes, la independencia y
los referendos desde la experiencia vivida en Escocia.

La sesión del viernes estará dedicada a las Islas Turcas y Caicos, Gibraltar y las Islas Malvinas, con
ponentes que expresarán distintos puntos de vista.
Abrirá la sesión Sir Robin Auld 7, nombrado Comisario único para la Comisión de Investigación de las
Islas Turcas y Caicos con su ponencia “La Comisión de Investigación de las Islas Turcas y Caicos sobre
corrupción pública 2008-2009: ayuda u obstáculo para la autodeterminación”. Tras éste intervendrá
Courtenay Griffiths 8, conocido por defender al expresidente de las Islas Turcas y Caicos, con su
ponencia “¿Es la idea de los Territorios Británicos de Ultramar una reliquia postcolonial sin cabida en
el siglo XXI? La experiencia de Gobierno Directo de las Islas Turcas y Caicos”.
A la sesión sobre las Islas Turcas y Caicos le seguirá la sesión sobre Gibraltar. Ésta comenzará con la
ponencia “La autodeterminación en la sombra de una reivindicación de soberanía: el caso de
Gibraltar”, pronunciada por el gibraltareño Jamie Trinidad 9, Investigador y Tutor del Wolfson College
de la Universidad de Cambridge. A continuación, Jennifer Ballantine-Perera, Directora de la
Biblioteca Garrison Library, pronunciará su ponencia “La autodeterminación como espectáculo: la
prensa y la primera visita de Gibraltar al Comité de los 24 de Naciones Unidas en septiembre de
1963”.
La sesión de la tarde se centrará en las Islas Malvinas. La primera intervención correrá a cargo de
Heriberto Cairo Carou 10, Decano del Departamento de Ciencias Políticas y de la Administración de la
Universidad Complutense de Madrid, quien hablará sobre “Los kelpers [malvinenses] y las relaciones
entre Argentina y el Reino Unido”. La siguiente ponencia será la de Marcelo Kohen, del Graduate
Institute de Ginebra 11, que versará sobre “Las Islas Malvinas y el derecho de su pueblo a la
autodeterminación”. La última ponencia sobre las Islas Malvinas vendrá desde Washington y correrá
a cargo de Luke Coffey 12, titular de la Cátedra Margaret Thatcher del Instituto Davis para la
Seguridad Nacional y Política Exterior de la Heritage Foundation, Washington. Coffey planteará la
cuestión de “Por qué Estados Unidos debería respaldar el derecho inalienable a la
autodeterminación de la población de las Islas Malvinas”.
El simposio será clausurado por Christopher Gardner 13, Presidente del Tribunal Supremo de las Islas
Malvinas, Islas Georgias del Sur y Sándwich del Sur, el Territorio Antártico Británico y el Territorio
Británico del Océano Índico.

High level panel for the symposium on "Self-determination, devolution and
independence in the 21st Century"
A symposium entitled "Self-determination, devolution and independence in the 21st
century" was opened by the Deputy Chief Minister Dr Joseph Garcia at the Garrison Library
this morning.
The symposium has been organised by Dr Jennifer Ballantine-Perera, Director of the
Garrison Library together with the Office of the Deputy Chief Minister.
A top-level panel from different countries composed of academics, jurists and other parties
relevant to the discussions will elaborate on the theme of the conference from their own
particular angle.
On the opening day, Sir Graham Watson will introduce the theme, "The development of the
idea of self-determination of peoples as expressed by US President Woodrow Wilson". He
will be followed by Robert Woodthorpe Browne MBE who sits on the Royal Institute for
Foreign Affairs Chatham House, is a member of the Bureau of Liberal International and
Chairman of the International Relations Committee of the Liberal Democrats. The title of his
address will be "Self-determination: An international liberal perspective." Dr Tom Grant
from the Lauterpacht Centre for International Law of the University of Cambridge will then
speak on "Self-determination in International Law: Past and Future(s)."
The afternoon session will see a discussion on devolution and independence which will be
opened by Joaquim Torra, the Director of the Born Cultural Centre in Catalunya who will
explore the developing situation there. He will be followed by Jon Inarritu Garcia, who is a
Basque member of the Spanish Parliament in Madrid who will address devolution and selfdetermination in the Basque country from his perspective. The next speaker will be
Professor Jesus Verdu Baeza who is the Director of the Algeciras Campus of the Faculty of
Law of the University of Cadiz who will give a Spanish perspective on the question of selfdetermination versus territorial integrity in relation to Gibraltar matters.

In the final contribution for that day, Professor Alan Boyle, Professor of Public International
Law at the University of Edinburgh, will then place devolution, independence and referenda
in the context of the Scottish experience.
The Friday session will deal with the Turks and Caicos, Gibraltar and the Falkland Islands
with speakers putting forward different points of view.
The session will open with Professor Sir Robin Auld who was appointed sole commissioner
of the Turks and Caicos Islands Commission of Inquiry, and who will address those present
on "Turks and Caicos Commission of Enquiry into Governmental Corruption 2008-2009:
Help or Hindrance to Self-determination." Sir Robin will be followed by Courtney Griffith
QC, who is noted for his continuing defence of the former leader of Turks and Caicos, on
the subject of "Is the idea of British Overseas Territories a Post Colonial Relic which has no
place in the 21st Century: The Turks and Caicos Experience of Direct Rule. "
The session on Turks and Caicos will be followed by the session on Gibraltar. This will start
with "Self-Determination in the shadow of a sovereignty claim: The case of Gibraltar" which
will be delivered by Gibraltarian Jamie Trinidad who is a Fellow and Tutor of Wolfson
College at the University of Cambridge. He will be followed by Dr Jennifer BallantinePerera, the Director of the Garrison Library, who will address the seminar on "Selfdetermination as spectacle: The press and Gibraltar's first visit to the UN Committee of 24
in September 1963."
The afternoon session will concentrate on the Falkland Islands. It will be opened by

back the inalienable right to self-determination of the Falkland Islanders."
