Information sought:
Appellant sought information with respect to post of Deputy Director-Administration, for
newly proposed six All India Institute of Medical Sciences under the Pradhan Mantri Swastha
Suraksha Yojna along with copies of note portion pages 1 to 50 of file No.A-11013/2/2009/SSH.
Relevant facts emerging during hearing:
Appellant is not present while the respondent is present and heard.
Appellant sought the above information by filing an RTI applications dated 11.07.2013 and
12.07.2013. Having not received any response from the public authority, appellant filed
second appeal before the Commission.
Respondent submitted that no such RTI applications are available in their record. In the
absence of the RTI applications, they are unable to provide any information to the appellant.
They further informed that they requested the appellant vide letter dated 27.01.2015 to provide
a copy of the RTI application so that the requisite information may be furnished to him.
During the hearing copies of the two RTI applications were provided to the appellant. In the
absence of the appellant his views could not be ascertained.
Decision:
After hearing respondent and on perusal of record, the Commission direct the respondent to
provide the information sought to the appellant within two weeks of receipt of this order under
intimation to the Commission.
The Commission with concern notes that it is quite strange that the two RTI applications and
the two first appeals sent by speed post in the name of the CPIO and FAA by the appellant have
not been received by the public authority.
The Commission is therefore directing the
Secretary, Ministry of Health & Family Welfare, to look into the matter as to how the
documents have not been received by the RTI Section of the Ministry and take appropriate
action under intimation to the Commission.
The appeals are disposed of accordingly.
