DS/NHP/0020139/000:i. Provide the year-wise annual statement of return submitted to the office by the above said establishment with the office w.e.f. 01/08/2000 till 30/04/2013. ii. Provide the information about the total EPF amount deposited by the above establishment in their employees account in the bank and out of the said total amount how many employees are/were paid their due EPF amount after leaving the job of the establishment and how much amount is still outstanding in their account to be paid to its employees. iii. Provide the information about the complete address of the Principal Employer/Government department with whom the establishment supplied the manpower. iv. Provide the information regarding the action taken against the establishment, in case it has not submitted the annual statement of returns with the office. v. Provide the information about the recovery action taken against the establishment, in case it failed to deposit the due EPF amount of the contract employee in its EPF account upto date. vi. If amount is not deposited in the account by the establishment then whether the action is initiated against the Principal Employer in view of provision of Section 8A of the Act read with Para 30(3) of the EPF Scheme, 1952 or not? Page 1 of 2 Grounds for the Second Appeal: The CPIO has not provided the desired information. Relevant Facts emerging during Hearing: The following were present Appellant: Absent Respondent: Mr. Ali Roshan CPIO M: 9818324356 The appellant was given an opportunity to participate in the hearing but he is absent. The CPIO stated that the appellant’s RTI application dated 12/11/2013 was replied vide letter dated 16/12/2013 and as directed by the FAA information has been provided to him on 18/02/2014. It is seen that the appellant made his 2nd appeal on 11/02/2014 i.e. before the respondent supplied information in compliance of the FAA’s order dated 23/01/2014. It is further seen that in his 2 nd appeal the appellant is seeking the list of workers covered by EPF and the total amount deposited by the establishment. He is also seeking the names of principal employer(s). The CPIO stated that he will provide the names of the workers who are covered under EPF and also the total amount deposited by the establishment. As regards the name(s) of principal employer(s) the CPIO stated that establishment is regular in depositing its dues and hence no such information is collected. Decision notice: As stated by the CPIO he should provide the list of employees/workers of M/s. Citadel Security Services who are covered under EPF and the total amount deposited by the establishment, to the appellant within 15 days from the date of receipt of this order.
