Riverside Water and Sewer District
obtains dismissal of lawsuit filed
against it by local contractors
The Riverside Water & Sewer District has successfully obtained a dismissal of a lawsuit
filed against it by Orofino residents John Anderson and Richard Burnham, who do business as
Riverview Construction.
Riverview Construction filed
suit against Riverside Water &
Sewer District and two of its contractors on a water line replacement project, Owyhee Construction and Taylor Engineering, in
August 2011, after asbestos-cement pipe was discovered on Riverview’s property in June 2010.
Riverside sought dismissal
of two claims filed against it for
Riverview’s failure to file a timely
claim under the Idaho Tort Claims
Act and for Riverview’s failure to
provide any evidence that Riverside violated state environmental
laws.
Riverside obtained dismissal of
the negligence claims asserted by
Riverview in November 2012, after Second District Court Judge
Michael Griffin held that Riverview failed to file a notice of tort
claim within the statutorily mandated 180 day period.
In the most recent order of dismissal, entered by Judge Griffin
on Dec. 15, 2014, the court held,
“There is no evidence to support
[Riverview’s] claim that [Riverside] had anything to do with the
removal of the contaminated soil
and its subsequent placement on
[Riverview’s] property.”
Following the dismissal of the
claims, Riverside filed a motion to
recover over $297,000 in attorney
fees and costs it has incurred in
defending the claims over the last
nearly four years. Riverview has
filed an objection to the request. A
hearing to consider the request is
scheduled for March 17, 2015.

The dates of this year’s festivities are Sept. 17-20.

Feb. 21, marks the momentous
17th annual dinner dance and
auction fundraiser for Clearwater
Valley Hospital and Clinics Foundation. “For the last several years
funds from this event have been
earmarked to go towards the new
clinic. This year will be especially
exciting because all of the people
who have supported this event
by coming, buying auction items,
and sponsoring will be able to get
an exclusive first look at the new
clinic, the Orofino Health Center,”
says Lenne Bonner, CAO.
Over the years this event has
raised over $60,000 that went
towards the construction of the
Orofino Health Center.
A cocktail hour will begin at
5:30 p.m. and will be held in the
classroom area of the new clinic,
set to open in March 2015. Everyone who purchases a ticket will
be invited. After the cocktail hour
event-goers will head to the Best
Western Lodge at River’s Edge for
live and silent auctions, dinner
and dancing to returning local favorites, the Kingpins.
“We hope that everyone will get
out their best black and white
outfits, or use this as an excuse
to get something new, and come
out for this exciting event! We have
changed up some of the live auction packages while still keeping
audience favorites in the mix,”
says Moonlight Ball committee
member, Shawna Altmiller. “As
