— Dispute resolution for .se domains
If you consider that someone else has registered a .se domain name
that you have the right to, it is possible to appeal the allocation of
the domain name afterwards. When it comes to a .se domain name,
“first come, first serve” is the general rule, which means that the
applicant for an available domain name can get it without a preliminary examination. Appeals of allocation of a .se domain name is
made through alternative dispute resolution procedure (ADR).
.SE offers ADR as an alternative to a
court ruling. ADR is legally secure,
faster and cheaper than a court proceeding and can be used by all who
consider that a name they have the
right to, for example a brand or company name, has been registered as a
.se domain name by someone else.
In an ADR case, three conditions
are examined and checked to make
sure that all are met for the applicant
to win the dispute.
1. The applicant must have a right
(for example a brand or company
name) valid in Sweden.
2. The holder of the domain name
has acted in bad faith when he or
she registered or used the domain
name.
3. The holder should not have a
right or legitimate interest to the
domain name.
.SE administers the ADR cases, but
arbitrators designated by .SE decide the cases. Normally, a solitary
lawyer settles a case, but if any of
the parties request it, three lawyers
will be assigned to decide the outcome. The lawyers are independent
from .SE and resolve matters independently based on the rules that
apply and the practice developed.
The procedure is written and the
parties shall, as a main rule, submit
only one piece each: the applicant
submit its application, the holder is
given the opportunity to respond,
and then the matter will be handed
over to the arbitrator.
A decision made in the ADR cases
cannot be appealed and will be put
into effect by .SE after 14 days. During this time, the holder then has
the possibility to take the dispute to
a court to have it examined there.
If such action is taken, .SE will halt
their actions of the ADR decision.
The applicant pays the cost for ADR.
Half of the fee that the applicant
pays for an ADR procedure is returned if the applicant wins. On SE’s

and payment terms. There is also a
current list of lawyers who are used
as arbitrators.

Disputes about
.nu domains
For disputes regarding .nu domain names, Uniform
Domain-Name Dispute-Resolution Policy (UDRP) will
be applied; a policy developed by ICANN for handling
disputes about domain names. UDRP was used for the
management of conflicts of .nu domain names before
.SE took over the operation and administration of the
top-level domain .nu. .SE has chosen to continue using
the UDRP as this is an established and well-functioning
dispute resolution model. You can read more about

Accelerated
Procedure
In an ADR case, the applicant can request a so-called
accelerated procedure. This means that if the holder
does not respond to the application, the arbitrator
will determine the outcome in ten days instead of
the normal 30 days, and the cost of the case may be
lower. On .SE’s website, you will find current rates
and payment terms. There is also a current list of

The website internetstatistik.se collects statistics
from five independent sources of internet statistics,
including our own reports. We also give out the
yearly report “Swedes and the Internet.”

With the Internet Fund, you can apply for
financing for independent projects that drive
the development of the internet forward in
Sweden.
