Executive Summary 2 Depending on the outcome of the resource consent application for discharge of treated wastewater to land north of Te Anau airport Manapouri, it may be necessary for Council to make certain decisions around next steps. Normally this would involve a discussion and resolution from elected members. Unfortunately looking at the expected date that a decision would be released and the following appeal period this does not align well with the normal six weekly meeting cycle. It is therefore recommended that the Mayor/Deputy Mayor and Chief Executive are granted delegated authority to make any decision on behalf of Council. Recommendation That the Council: a) Receives the report titled “Te Anau Wastewater Consent Application Delegated Authority” dated 28 January 2015. b) Determines that this matter or decision be recognised as not significant in terms of Section 76 of the Local Government Act 2002. c) Determines that it has complied with the decision making provisions of the Local Government Act 2002 to the extent necessary in relation to this decision; and in accordance with Section 79 of the Act determines that it does not require further information, further assessment of options or further analysis of costs and benefits or advantages and disadvantages prior to making a decision on this matter. d) Grants delegated authority to the Mayor/Deputy Mayor and Chief Executive to make any decisions on behalf of Council in respect of the pending Te Anau wastewater discharge consent application. 8.2 Te Anau Wastewater Consent Application - Delegated Authority Page 11 Item 8.2 Council 28 January 2015 Item 8.2 Council 28 January 2015 Content Background 3 The reconvened hearing for the Te Anau wastewater consent finished on 19 November. Prior to concluding the Commissioners requested an extension of time to consider submissions and issue a decision. It was indicated that an extension to late January would be required to write up and issue the decision. Under the Resource Management Act there will then be an appeal period of 20 working days bringing the time up to the last week in February. 4 Depending on the outcome of the process and/or potential conditions it is possible that Council may want to lodge an appeal with the Environment Court. This would require direction from Council if an appeal was believed necessary. Unfortunately this is unlikely to align with the six week Council cycle. 5 Given the relatively tight timescales to consider the decision, and the fact that there is a need to act quickly when considering options Council staff are therefore recommending that delegated authority is granted to the Chief Executive and Mayor/Deputy Mayor to make the final decision on whether to lodge an appeal. Any decisions made will be reported back to Council at its next meeting. Issues 6 The recommendation is required to ensure that Council can act within the statutory timeframes laid down in the Resource Management Act. Factors to Consider Legal and Statutory Requirements 7 The application and hearing have been conducted under the provisions of the Resource Management Act 1992. Council will continue to act under these provisions until an outcome is known. Community Views 8 The proposal has been consulted on in previous Long Term Plan/Annual Plans with public meetings and open days to discuss the proposal having been held. Costs and Funding 9 The funding for this proposal has been included in previous Long Term/Annual Plans and has been reviewed and revised as scope is altered. Policy Implications 10 There are no significant policy implications associated with this recommendation. 8.2 Te Anau Wastewater Consent Application - Delegated Authority Page 12 Analysis Options Considered 11 Given the timing of and expected decision and need to act quickly within the statutory appeal period the preferred option is to grant delegated authority to the Mayor/Deputy Mayor and Chief Executive to make decisions on behalf of Council. The next meeting of Council is set for 18 March which is well outside the 20 working day statutory appeal period. Assessment of Significance 12 Upon assessing the proposed recommendation against the Council’s Significance and Engagement Policy, Water and Waste Services believes that the recommendation does not constitute a significant decision. 13 This is based on the recommendation not having an impact on the Council’s direction and level of service and the cost being less than 10% of annual expenditure. Recommended Option 14 The recommended option is to grant delegated authority to the Mayor/Deputy Mayor and Chief Executive to make decisions on behalf of Council. These will be reported back to Council at its next meeting. Next Steps 15 Council staff will review the Commissioners’ decision once it has been released and advise the delegated party of appropriate next steps, those being to either accept the decision or to lodge an appeal with the Environment Court. Executive Summary 2 The current membership of the International Relations Committee would like to extend their membership to include two new young people, as per the delegation. The Committee have undertaken an extensive outreach to find two young people, and have selected them for Council’s approval. Recommendation That the Council: a) Receive the report titled “International Relations Committee - New Member” dated 28 January 2015. b) Determine that this matter or decision be recognised as not significant in terms of Section 76 of the Local Government Act 2002. c) Determine that it has complied with the decision making provisions of the Local Government Act 2002 to the extent necessary in relation to this decision; and in accordance with Section 79 of the Act determines that it does not require further information, further assessment of options or further analysis of costs and benefits or advantages and disadvantages prior to making a decision on this matter. d) Decide to appoint Mei Ling Au to the International Relations Committee until the duration of her appointment to last to the next triennium. e) Decide to appoint Robbie Grove to the International Relations Committee, the duration of his appointment to last to the end of 2015. 9.1 International Relations Committee - New Member Page 41 Item 9.1 Council 28 January 2015 Content Background 3 In May 2014, a review of the International Relations Committee (formerly the Friendship Committee) was undertaken. It was established that the membership of the Committee should be increased to include two young people to provide a representative and innovative views to the Committee, regarding international relations. The Delegation and Terms of Reference was reviewed to reflect this view. 4 The International Relations Committee sought to undertake an application process to obtain a young professional in early November 2014. Advertising was mostly undertaken on Facebook, reaching over 8000 18-35 years olds in the District, as well as in the Southland Express. 33 applications were received by the Committee. The Committee selected two candidates through a set of criteria, which included living in the District, being available for meetings, an interest in international relations, and proposing new ideas. One candidate declined the opportunity to be on the Committee; therefore, only one young professional, Mei Ling Au, is awaiting appointment to the Committee. 5 Also at the November 2014 meeting, the International Relations Committee decided to establish a Youth Ambassador position. This position is for a school-aged young person, who will attend all International Relations Committee meetings for the duration of one year, and will undertake an international project. The proposal came from Aparima College student, Robbie Grove, who is undertaking the Youth to Everest trip in 2015. Issues 6 That the Committee is requesting additional membership outside of a triennium, to meet their delegation. Factors to Consider Legal and Statutory Requirements 7 Council has delegation to appoint members of the public to a standing committee, of which the International Relations Committee is one, particularly if the member(s) of the public has specialist knowledge that would assist the committee. Community Views 8 The International Relations Committee is a committee of Council and is created to represent the publics’ views on international relations to Council. The Committee has requested that young people be incorporated into the Committee, in the form of young professional(s) and student(s) to generate a wider range of community views. 9 Given the extent to which the advertising reached the public of Southland, and the positive response Council received, it is perceived that the community are comfortable with the International Relations Committee membership being extended to include young people. Costs and Funding 10 There are very few increased costs of three new members on the Committee, other than mileage payments and food which is provided for meetings every three months. It is estimated that these costs would come to $188.03 in petrol per meeting. 9.1 International Relations Committee - New Member Page 42 11 The International Relations Committee have established a grant for the Youth Ambassador position of up to $1000 for one year, to assist with international project fees. Policy Implications 12 There are no policy implications for additional membership within the delegation.
